各省、自治區、直轄市人民政府,國務院各部委、各直屬機構:

  解決拖欠(qian)農(nong)(nong)民(min)工(gong)(gong)工(gong)(gong)資(zi)(zi)問題(ti)(ti),事(shi)(shi)關廣大(da)農(nong)(nong)民(min)工(gong)(gong)切身(shen)利益,事(shi)(shi)關社(she)(she)會(hui)公平正義和社(she)(she)會(hui)和諧穩定。黨(dang)中央(yang)、國(guo)(guo)務院歷來高度(du)重視,先(xian)后出臺了一(yi)系列政策措(cuo)施(shi),各地區、各有(you)關部門加大(da)工(gong)(gong)作力度(du),經(jing)過多年治理(li)取得(de)了明顯(xian)成效。但也要看(kan)到,這一(yi)問題(ti)(ti)尚未得(de)到根本解決,部分行業特(te)別是工(gong)(gong)程(cheng)建設(she)領(ling)域(yu)拖欠(qian)工(gong)(gong)資(zi)(zi)問題(ti)(ti)仍較(jiao)突出,一(yi)些政府投資(zi)(zi)工(gong)(gong)程(cheng)項目不同程(cheng)度(du)存(cun)在拖欠(qian)農(nong)(nong)民(min)工(gong)(gong)工(gong)(gong)資(zi)(zi)問題(ti)(ti),嚴(yan)重侵(qin)害了農(nong)(nong)民(min)工(gong)(gong)合法權益,由此引發(fa)的(de)群體性事(shi)(shi)件(jian)時有(you)發(fa)生,影響社(she)(she)會(hui)穩定。為全面治理(li)拖欠(qian)農(nong)(nong)民(min)工(gong)(gong)工(gong)(gong)資(zi)(zi)問題(ti)(ti),經(jing)國(guo)(guo)務院同意,現(xian)提出如(ru)下意見(jian):

  一、總體要求

  (一)指(zhi)導思(si)想。全面貫(guan)徹黨(dang)的十八(ba)大和(he)十八(ba)屆二中、三中、四中、五中全會精神,按照“四個(ge)全面”戰略布(bu)局和(he)黨(dang)中央、國務院決(jue)策部署,牢固(gu)樹立并切實(shi)貫(guan)徹創新、協調、綠色、開放、共享的發展理念,緊緊圍繞(rao)保(bao)護(hu)農(nong)民(min)工(gong)勞(lao)(lao)動所得(de),堅持標(biao)本兼(jian)治、綜(zong)合治理,著力規范工(gong)資(zi)支(zhi)付行為、優化(hua)市場環(huan)境、強化(hua)監(jian)管責任,健全預防和(he)解決(jue)拖欠農(nong)民(min)工(gong)工(gong)資(zi)問題的長(chang)效機制,切實(shi)保(bao)障農(nong)民(min)工(gong)勞(lao)(lao)動報酬權益,維(wei)護(hu)社會公(gong)平正(zheng)義(yi),促進(jin)社會和(he)諧穩定(ding)。

  (二)目(mu)標任務(wu)。以(yi)建(jian)筑(zhu)市政、交通、水利等工(gong)程建(jian)設(she)領域(yu)和(he)勞動密集(ji)型加工(gong)制(zhi)(zhi)(zhi)造、餐飲服務(wu)等易發生拖(tuo)欠工(gong)資問題(ti)的行業為重(zhong)點,健全源頭(tou)預防(fang)、動態監(jian)管、失信懲戒(jie)相(xiang)結合的制(zhi)(zhi)(zhi)度保障體(ti)系,完善市場主(zhu)體(ti)自律(lv)、政府依法(fa)監(jian)管、社會協同監(jian)督、司法(fa)聯(lian)動懲處的工(gong)作體(ti)系。到(dao)2020年,形成制(zhi)(zhi)(zhi)度完備(bei)、責任落實、監(jian)管有力的治理(li)格局(ju),使拖(tuo)欠農民工(gong)工(gong)資問題(ti)得(de)到(dao)根本遏(e)制(zhi)(zhi)(zhi),努力實現(xian)基本無拖(tuo)欠。

  二、全面規范(fan)企業工資支付(fu)行為

  (三)明確工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)支付(fu)各方主體(ti)責(ze)(ze)任(ren)。全面落實企(qi)業(ye)(ye)(ye)(ye)對招用(yong)農民(min)工(gong)(gong)(gong)(gong)(gong)的(de)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)支付(fu)責(ze)(ze)任(ren),督促各類(lei)企(qi)業(ye)(ye)(ye)(ye)嚴格(ge)依法將工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)按月足額支付(fu)給農民(min)工(gong)(gong)(gong)(gong)(gong)本人,嚴禁將工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)發(fa)放給不(bu)具備用(yong)工(gong)(gong)(gong)(gong)(gong)主體(ti)資(zi)(zi)(zi)格(ge)的(de)組織和個人。在工(gong)(gong)(gong)(gong)(gong)程(cheng)建(jian)設領域,施(shi)工(gong)(gong)(gong)(gong)(gong)總(zong)承(cheng)包(bao)(bao)企(qi)業(ye)(ye)(ye)(ye)(包(bao)(bao)括(kuo)直接(jie)承(cheng)包(bao)(bao)建(jian)設單位發(fa)包(bao)(bao)工(gong)(gong)(gong)(gong)(gong)程(cheng)的(de)專(zhuan)業(ye)(ye)(ye)(ye)承(cheng)包(bao)(bao)企(qi)業(ye)(ye)(ye)(ye),下同(tong)(tong))對所承(cheng)包(bao)(bao)工(gong)(gong)(gong)(gong)(gong)程(cheng)項(xiang)目的(de)農民(min)工(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)支付(fu)負(fu)總(zong)責(ze)(ze),分包(bao)(bao)企(qi)業(ye)(ye)(ye)(ye)(包(bao)(bao)括(kuo)承(cheng)包(bao)(bao)施(shi)工(gong)(gong)(gong)(gong)(gong)總(zong)承(cheng)包(bao)(bao)企(qi)業(ye)(ye)(ye)(ye)發(fa)包(bao)(bao)工(gong)(gong)(gong)(gong)(gong)程(cheng)的(de)專(zhuan)業(ye)(ye)(ye)(ye)企(qi)業(ye)(ye)(ye)(ye),下同(tong)(tong))對所招用(yong)農民(min)工(gong)(gong)(gong)(gong)(gong)的(de)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi)支付(fu)負(fu)直接(jie)責(ze)(ze)任(ren),不(bu)得以(yi)工(gong)(gong)(gong)(gong)(gong)程(cheng)款(kuan)未到位等為由克扣或拖欠農民(min)工(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(zi),不(bu)得將合同(tong)(tong)應收工(gong)(gong)(gong)(gong)(gong)程(cheng)款(kuan)等經營風險轉(zhuan)嫁給農民(min)工(gong)(gong)(gong)(gong)(gong)。

  (四)嚴格規范勞(lao)(lao)動(dong)用工(gong)(gong)(gong)(gong)(gong)管理。督(du)促各(ge)類(lei)企(qi)業(ye)依(yi)法與(yu)招用的農(nong)民工(gong)(gong)(gong)(gong)(gong)簽(qian)訂勞(lao)(lao)動(dong)合(he)同(tong)并嚴格履行(xing),建立職工(gong)(gong)(gong)(gong)(gong)名(ming)冊并辦理勞(lao)(lao)動(dong)用工(gong)(gong)(gong)(gong)(gong)備(bei)(bei)案。在(zai)工(gong)(gong)(gong)(gong)(gong)程建設領(ling)域(yu),堅持施(shi)工(gong)(gong)(gong)(gong)(gong)企(qi)業(ye)與(yu)農(nong)民工(gong)(gong)(gong)(gong)(gong)先簽(qian)訂勞(lao)(lao)動(dong)合(he)同(tong)后進(jin)場施(shi)工(gong)(gong)(gong)(gong)(gong),全面實(shi)(shi)行(xing)農(nong)民工(gong)(gong)(gong)(gong)(gong)實(shi)(shi)名(ming)制(zhi)管理制(zhi)度(du),建立勞(lao)(lao)動(dong)計(ji)酬手冊,記(ji)錄(lu)施(shi)工(gong)(gong)(gong)(gong)(gong)現場作業(ye)農(nong)民工(gong)(gong)(gong)(gong)(gong)的身份信息、勞(lao)(lao)動(dong)考(kao)勤、工(gong)(gong)(gong)(gong)(gong)資結算等(deng)信息,逐步(bu)實(shi)(shi)現信息化實(shi)(shi)名(ming)制(zhi)管理。施(shi)工(gong)(gong)(gong)(gong)(gong)總承包(bao)企(qi)業(ye)要加強對分包(bao)企(qi)業(ye)勞(lao)(lao)動(dong)用工(gong)(gong)(gong)(gong)(gong)和(he)工(gong)(gong)(gong)(gong)(gong)資發放的監督(du)管理,在(zai)工(gong)(gong)(gong)(gong)(gong)程項目部配備(bei)(bei)勞(lao)(lao)資專管員,建立施(shi)工(gong)(gong)(gong)(gong)(gong)人員進(jin)出場登記(ji)制(zhi)度(du)和(he)考(kao)勤計(ji)量(liang)、工(gong)(gong)(gong)(gong)(gong)資支付等(deng)管理臺(tai)賬,實(shi)(shi)時掌握施(shi)工(gong)(gong)(gong)(gong)(gong)現場用工(gong)(gong)(gong)(gong)(gong)及(ji)其(qi)工(gong)(gong)(gong)(gong)(gong)資支付情況,不得(de)以(yi)包(bao)代管。施(shi)工(gong)(gong)(gong)(gong)(gong)總承包(bao)企(qi)業(ye)和(he)分包(bao)企(qi)業(ye)應將經(jing)農(nong)民工(gong)(gong)(gong)(gong)(gong)本人簽(qian)字確認(ren)的工(gong)(gong)(gong)(gong)(gong)資支付書(shu)面記(ji)錄(lu)保存兩年以(yi)上備(bei)(bei)查。

  (五)推行(xing)(xing)銀行(xing)(xing)代(dai)(dai)發(fa)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)制(zhi)度。推動各類企(qi)業(ye)(ye)委(wei)托銀行(xing)(xing)代(dai)(dai)發(fa)農(nong)民(min)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)。在工(gong)(gong)(gong)(gong)(gong)(gong)(gong)程建設(she)領域,鼓勵實(shi)行(xing)(xing)分(fen)包企(qi)業(ye)(ye)農(nong)民(min)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)委(wei)托施(shi)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)總(zong)承(cheng)包企(qi)業(ye)(ye)直接代(dai)(dai)發(fa)的辦法。分(fen)包企(qi)業(ye)(ye)負責為招用的農(nong)民(min)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)申辦銀行(xing)(xing)個人(ren)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)賬戶并辦理實(shi)名制(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)支付(fu)銀行(xing)(xing)卡,按月(yue)考核農(nong)民(min)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)作量并編制(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)支付(fu)表,經農(nong)民(min)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)本人(ren)簽字確認后,交施(shi)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)總(zong)承(cheng)包企(qi)業(ye)(ye)委(wei)托銀行(xing)(xing)通過其設(she)立的農(nong)民(min)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(勞(lao)務費)專用賬戶直接將工(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)劃入農(nong)民(min)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)個人(ren)工(gong)(gong)(gong)(gong)(gong)(gong)(gong)資(zi)賬戶。

  三(san)、健(jian)全(quan)工資支付監(jian)控和(he)保(bao)障制度

  (六)完善企(qi)(qi)業(ye)(ye)(ye)工資(zi)(zi)支(zhi)付(fu)監控機制。構建(jian)企(qi)(qi)業(ye)(ye)(ye)工資(zi)(zi)支(zhi)付(fu)監控網絡(luo),依托基(ji)層(ceng)勞(lao)動保(bao)障監察網格化、網絡(luo)化管理平臺的工作(zuo)(zuo)人員和基(ji)層(ceng)工會組(zu)(zu)織(zhi)(zhi)設立的勞(lao)動法(fa)律監督員,對(dui)轄區內企(qi)(qi)業(ye)(ye)(ye)工資(zi)(zi)支(zhi)付(fu)情(qing)況實行日常監管,對(dui)發生(sheng)(sheng)過拖欠(qian)工資(zi)(zi)的企(qi)(qi)業(ye)(ye)(ye)實行重(zhong)(zhong)點監控并(bing)要求其定(ding)期申報。企(qi)(qi)業(ye)(ye)(ye)確因(yin)生(sheng)(sheng)產經營困(kun)難等原(yuan)因(yin)需(xu)要延期支(zhi)付(fu)農(nong)民工工資(zi)(zi)的,應及(ji)時(shi)向(xiang)當(dang)地人力(li)資(zi)(zi)源社會保(bao)障部門、工會組(zu)(zu)織(zhi)(zhi)報告。建(jian)立和完善欠(qian)薪預(yu)警系統(tong),根據工商、稅務(wu)、銀(yin)行、水電供應等單位(wei)反映的企(qi)(qi)業(ye)(ye)(ye)生(sheng)(sheng)產經營狀況相關指標變(bian)化情(qing)況,定(ding)期對(dui)重(zhong)(zhong)點行業(ye)(ye)(ye)企(qi)(qi)業(ye)(ye)(ye)進行綜(zong)合分析研判,發現欠(qian)薪隱(yin)患要及(ji)時(shi)預(yu)警并(bing)做好防范工作(zuo)(zuo)。

  (七)完善工(gong)(gong)(gong)資(zi)(zi)(zi)保(bao)(bao)證(zheng)(zheng)金(jin)(jin)制(zhi)度(du)。在建筑市政、交通、水利等工(gong)(gong)(gong)程建設領域全面實(shi)行工(gong)(gong)(gong)資(zi)(zi)(zi)保(bao)(bao)證(zheng)(zheng)金(jin)(jin)制(zhi)度(du),逐步將實(shi)施(shi)范圍擴大到(dao)其他易發(fa)生拖欠工(gong)(gong)(gong)資(zi)(zi)(zi)的(de)行業。建立(li)工(gong)(gong)(gong)資(zi)(zi)(zi)保(bao)(bao)證(zheng)(zheng)金(jin)(jin)差(cha)異(yi)化繳(jiao)存辦法(fa),對(dui)一(yi)定時期內(nei)未(wei)發(fa)生工(gong)(gong)(gong)資(zi)(zi)(zi)拖欠的(de)企(qi)業實(shi)行減免措施(shi)、發(fa)生工(gong)(gong)(gong)資(zi)(zi)(zi)拖欠的(de)企(qi)業適當提高繳(jiao)存比例(li)。嚴格規范工(gong)(gong)(gong)資(zi)(zi)(zi)保(bao)(bao)證(zheng)(zheng)金(jin)(jin)動用和(he)退還(huan)辦法(fa)。探索推行業主擔保(bao)(bao)、銀行保(bao)(bao)函等第三方擔保(bao)(bao)制(zhi)度(du),積極引入商(shang)業保(bao)(bao)險機制(zhi),保(bao)(bao)障農民工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)(zi)(zi)支付。

  (八)建立健全農民(min)工(gong)(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(勞務(wu)費(fei))專(zhuan)用賬(zhang)戶管理(li)制度。在(zai)工(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)建設(she)領(ling)域,實行(xing)人(ren)工(gong)(gong)(gong)(gong)(gong)(gong)費(fei)用與(yu)其他工(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)款分賬(zhang)管理(li)制度,推動農民(min)工(gong)(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)與(yu)工(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)材料款等(deng)(deng)相分離。施(shi)工(gong)(gong)(gong)(gong)(gong)(gong)總(zong)承(cheng)包(bao)(bao)企(qi)業應(ying)分解工(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)價(jia)款中(zhong)的人(ren)工(gong)(gong)(gong)(gong)(gong)(gong)費(fei)用,在(zai)工(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)項(xiang)目所在(zai)地銀行(xing)開設(she)農民(min)工(gong)(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(勞務(wu)費(fei))專(zhuan)用賬(zhang)戶,專(zhuan)項(xiang)用于(yu)支付農民(min)工(gong)(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)。建設(she)單(dan)位應(ying)按照工(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)承(cheng)包(bao)(bao)合同約定的比例或施(shi)工(gong)(gong)(gong)(gong)(gong)(gong)總(zong)承(cheng)包(bao)(bao)企(qi)業提供的人(ren)工(gong)(gong)(gong)(gong)(gong)(gong)費(fei)用數額(e),將應(ying)付工(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)款中(zhong)的人(ren)工(gong)(gong)(gong)(gong)(gong)(gong)費(fei)單(dan)獨撥(bo)付到施(shi)工(gong)(gong)(gong)(gong)(gong)(gong)總(zong)承(cheng)包(bao)(bao)企(qi)業開設(she)的農民(min)工(gong)(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(勞務(wu)費(fei))專(zhuan)用賬(zhang)戶。農民(min)工(gong)(gong)(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)(gong)(gong)資(zi)(zi)(勞務(wu)費(fei))專(zhuan)用賬(zhang)戶應(ying)向人(ren)力資(zi)(zi)源社會(hui)保障(zhang)部門(men)和(he)交通(tong)(tong)、水(shui)利等(deng)(deng)工(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)建設(she)項(xiang)目主(zhu)管部門(men)備案,并委(wei)托開戶銀行(xing)負責日常(chang)監管,確保專(zhuan)款專(zhuan)用。開戶銀行(xing)發現(xian)賬(zhang)戶資(zi)(zi)金不足、被挪用等(deng)(deng)情況,應(ying)及時(shi)向人(ren)力資(zi)(zi)源社會(hui)保障(zhang)部門(men)和(he)交通(tong)(tong)、水(shui)利等(deng)(deng)工(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)(cheng)建設(she)項(xiang)目主(zhu)管部門(men)報告。

  (九(jiu))落實清(qing)償欠(qian)薪責任。招用農(nong)民(min)工(gong)(gong)(gong)的(de)企(qi)(qi)(qi)業承(cheng)(cheng)擔(dan)直接(jie)清(qing)償拖(tuo)欠(qian)農(nong)民(min)工(gong)(gong)(gong)工(gong)(gong)(gong)資的(de)主(zhu)體責任。在(zai)工(gong)(gong)(gong)程建設(she)領域,建設(she)單(dan)位(wei)或(huo)(huo)(huo)(huo)施工(gong)(gong)(gong)總(zong)承(cheng)(cheng)包(bao)(bao)(bao)企(qi)(qi)(qi)業未(wei)按合同約定及時劃撥工(gong)(gong)(gong)程款,致使分包(bao)(bao)(bao)企(qi)(qi)(qi)業拖(tuo)欠(qian)農(nong)民(min)工(gong)(gong)(gong)工(gong)(gong)(gong)資的(de),由建設(she)單(dan)位(wei)或(huo)(huo)(huo)(huo)施工(gong)(gong)(gong)總(zong)承(cheng)(cheng)包(bao)(bao)(bao)企(qi)(qi)(qi)業以未(wei)結清(qing)的(de)工(gong)(gong)(gong)程款為(wei)限先行墊付(fu)農(nong)民(min)工(gong)(gong)(gong)工(gong)(gong)(gong)資。建設(she)單(dan)位(wei)或(huo)(huo)(huo)(huo)施工(gong)(gong)(gong)總(zong)承(cheng)(cheng)包(bao)(bao)(bao)企(qi)(qi)(qi)業將(jiang)工(gong)(gong)(gong)程違(wei)法發包(bao)(bao)(bao)、轉包(bao)(bao)(bao)或(huo)(huo)(huo)(huo)違(wei)法分包(bao)(bao)(bao)致使拖(tuo)欠(qian)農(nong)民(min)工(gong)(gong)(gong)工(gong)(gong)(gong)資的(de),由建設(she)單(dan)位(wei)或(huo)(huo)(huo)(huo)施工(gong)(gong)(gong)總(zong)承(cheng)(cheng)包(bao)(bao)(bao)企(qi)(qi)(qi)業依法承(cheng)(cheng)擔(dan)清(qing)償責任。

  四(si)、推(tui)進企業(ye)工資支付誠信體(ti)系建設

  (十)完善(shan)企(qi)(qi)(qi)業(ye)(ye)守法誠信(xin)(xin)管理制度(du)(du)。將勞動(dong)(dong)用(yong)(yong)(yong)工(gong)(gong)(gong)、工(gong)(gong)(gong)資(zi)支付情況作(zuo)為企(qi)(qi)(qi)業(ye)(ye)誠信(xin)(xin)評價的重要依據,實行分類分級動(dong)(dong)態監(jian)管。建立(li)拖(tuo)欠工(gong)(gong)(gong)資(zi)企(qi)(qi)(qi)業(ye)(ye)“黑(hei)名(ming)單”制度(du)(du),定(ding)期向社會公開(kai)有關(guan)信(xin)(xin)息(xi)(xi)。人力資(zi)源(yuan)社會保障(zhang)部(bu)門要建立(li)企(qi)(qi)(qi)業(ye)(ye)拖(tuo)欠工(gong)(gong)(gong)資(zi)等(deng)違法信(xin)(xin)息(xi)(xi)的歸(gui)集、交(jiao)換和更新機制,將查處的企(qi)(qi)(qi)業(ye)(ye)拖(tuo)欠工(gong)(gong)(gong)資(zi)情況納入人民銀行企(qi)(qi)(qi)業(ye)(ye)征信(xin)(xin)系統(tong)(tong)、工(gong)(gong)(gong)商部(bu)門企(qi)(qi)(qi)業(ye)(ye)信(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)息(xi)(xi)公示系統(tong)(tong)、住房(fang)城鄉建設等(deng)行業(ye)(ye)主管部(bu)門誠信(xin)(xin)信(xin)(xin)息(xi)(xi)平臺(tai)或政府(fu)公共(gong)信(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)息(xi)(xi)服(fu)務(wu)平臺(tai)。推進(jin)相關(guan)信(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)息(xi)(xi)系統(tong)(tong)互(hu)聯互(hu)通,實現(xian)對企(qi)(qi)(qi)業(ye)(ye)信(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)息(xi)(xi)互(hu)認共(gong)享。

  (十一)建(jian)立健(jian)全企(qi)(qi)業(ye)(ye)失(shi)(shi)信聯合懲(cheng)戒機制。加強對企(qi)(qi)業(ye)(ye)失(shi)(shi)信行為(wei)的部門(men)協同(tong)監管和聯合懲(cheng)戒,對拖(tuo)欠工資的失(shi)(shi)信企(qi)(qi)業(ye)(ye),由有關部門(men)在(zai)政(zheng)府資金支(zhi)持(chi)、政(zheng)府采購、招(zhao)投標、生產許可(ke)、履約擔保、資質審(shen)核、融資貸款、市場準入、評優(you)評先等方面依法(fa)依規(gui)予以限(xian)制,使失(shi)(shi)信企(qi)(qi)業(ye)(ye)在(zai)全國范圍內“一處(chu)違法(fa)、處(chu)處(chu)受限(xian)”,提高企(qi)(qi)業(ye)(ye)失(shi)(shi)信違法(fa)成本。

  五、依法處置(zhi)拖欠工資(zi)案件(jian)

  (十(shi)二(er))嚴厲查(cha)處(chu)拖欠(qian)工(gong)(gong)資(zi)行為。加強工(gong)(gong)資(zi)支付(fu)監察執(zhi)法(fa)(fa),擴(kuo)大(da)(da)日常巡視檢查(cha)和(he)書面材(cai)料審查(cha)覆蓋范圍,推進勞(lao)動(dong)(dong)(dong)保(bao)(bao)障監察舉報(bao)投訴(su)案(an)(an)件省級(ji)聯(lian)動(dong)(dong)(dong)處(chu)理機(ji)(ji)制(zhi)(zhi)建設,加大(da)(da)拖欠(qian)農(nong)民(min)工(gong)(gong)工(gong)(gong)資(zi)舉報(bao)投訴(su)受理和(he)案(an)(an)件查(cha)處(chu)力度(du)。完(wan)善(shan)多部門聯(lian)合治理機(ji)(ji)制(zhi)(zhi),深(shen)入開展農(nong)民(min)工(gong)(gong)工(gong)(gong)資(zi)支付(fu)情況專(zhuan)項檢查(cha)。健全地區執(zhi)法(fa)(fa)協作制(zhi)(zhi)度(du),加強跨區域(yu)案(an)(an)件執(zhi)法(fa)(fa)協作。完(wan)善(shan)勞(lao)動(dong)(dong)(dong)保(bao)(bao)障監察行政(zheng)執(zhi)法(fa)(fa)與刑事(shi)司法(fa)(fa)銜(xian)接機(ji)(ji)制(zhi)(zhi),健全勞(lao)動(dong)(dong)(dong)保(bao)(bao)障監察機(ji)(ji)構(gou)、公安機(ji)(ji)關、檢察機(ji)(ji)關、審判(pan)機(ji)(ji)關間信息共享(xiang)、案(an)(an)情通(tong)報(bao)、案(an)(an)件移(yi)送等制(zhi)(zhi)度(du),推動(dong)(dong)(dong)完(wan)善(shan)人(ren)民(min)檢察院(yuan)立案(an)(an)監督和(he)人(ren)民(min)法(fa)(fa)院(yuan)及(ji)時財產(chan)保(bao)(bao)全等制(zhi)(zhi)度(du)。對惡意欠(qian)薪涉嫌犯罪的,依法(fa)(fa)移(yi)送司法(fa)(fa)機(ji)(ji)關追究刑事(shi)責任,切實發(fa)揮刑法(fa)(fa)對打擊拒不(bu)支付(fu)勞(lao)動(dong)(dong)(dong)報(bao)酬(chou)犯罪行為的威懾作用。

  (十三)及時(shi)(shi)處理(li)欠(qian)(qian)薪(xin)(xin)爭(zheng)議(yi)(yi)案件(jian)。充分發揮基(ji)層勞(lao)動(dong)爭(zheng)議(yi)(yi)調(diao)(diao)解等組(zu)織的作用,引導農民工(gong)就(jiu)地就(jiu)近解決(jue)工(gong)資(zi)(zi)爭(zheng)議(yi)(yi)。勞(lao)動(dong)人(ren)事(shi)爭(zheng)議(yi)(yi)仲裁(cai)(cai)(cai)機構對(dui)農民工(gong)因拖(tuo)欠(qian)(qian)工(gong)資(zi)(zi)申請(qing)仲裁(cai)(cai)(cai)的爭(zheng)議(yi)(yi)案件(jian)優(you)先受理(li)、優(you)先開庭(ting)、及時(shi)(shi)裁(cai)(cai)(cai)決(jue)、快(kuai)速結案。對(dui)集體欠(qian)(qian)薪(xin)(xin)爭(zheng)議(yi)(yi)或涉及金額較大的欠(qian)(qian)薪(xin)(xin)爭(zheng)議(yi)(yi)案件(jian)要掛牌督辦。加強(qiang)裁(cai)(cai)(cai)審(shen)銜接與(yu)工(gong)作協(xie)調(diao)(diao),提(ti)高欠(qian)(qian)薪(xin)(xin)爭(zheng)議(yi)(yi)案件(jian)裁(cai)(cai)(cai)決(jue)效率。暢(chang)通申請(qing)渠(qu)道,依法及時(shi)(shi)為農民工(gong)討薪(xin)(xin)提(ti)供法律(lv)服務和法律(lv)援助。

  (十四)完(wan)善欠(qian)薪(xin)突發(fa)(fa)事(shi)件應急(ji)處置機制。健全應急(ji)預案(an),及(ji)時(shi)妥善處置因拖欠(qian)農民工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)引發(fa)(fa)的突發(fa)(fa)性、群體性事(shi)件。完(wan)善欠(qian)薪(xin)應急(ji)周轉金制度,探(tan)索建立欠(qian)薪(xin)保障金制度,對(dui)(dui)企業(ye)一時(shi)難(nan)以(yi)解(jie)決拖欠(qian)工(gong)(gong)(gong)資(zi)或企業(ye)主欠(qian)薪(xin)逃匿的,及(ji)時(shi)動用(yong)應急(ji)周轉金、欠(qian)薪(xin)保障金或通(tong)過其(qi)他渠道籌措資(zi)金,先行(xing)墊付部分工(gong)(gong)(gong)資(zi)或基本生活費,幫(bang)助解(jie)決被拖欠(qian)工(gong)(gong)(gong)資(zi)農民工(gong)(gong)(gong)的臨(lin)時(shi)生活困(kun)難(nan)。對(dui)(dui)采取非(fei)法(fa)手段討(tao)薪(xin)或以(yi)拖欠(qian)工(gong)(gong)(gong)資(zi)為名討(tao)要(yao)工(gong)(gong)(gong)程款,構成違反治安(an)管理行(xing)為的,要(yao)依法(fa)予以(yi)治安(an)處罰;涉(she)嫌(xian)犯罪的,依法(fa)移送司法(fa)機關追究刑事(shi)責任。

  六、改進建設領域工(gong)程款支付管理和用工(gong)方式

  (十五(wu))加(jia)強建(jian)設(she)資(zi)(zi)(zi)(zi)金(jin)監管。在工(gong)(gong)(gong)程建(jian)設(she)領域推行工(gong)(gong)(gong)程款支付擔(dan)保(bao)制度,采用經(jing)濟手段約束建(jian)設(she)單位履約行為,預防工(gong)(gong)(gong)程款拖欠。加(jia)強對政府(fu)投(tou)(tou)資(zi)(zi)(zi)(zi)工(gong)(gong)(gong)程項(xiang)目(mu)的管理,對建(jian)設(she)資(zi)(zi)(zi)(zi)金(jin)來源不(bu)落實的政府(fu)投(tou)(tou)資(zi)(zi)(zi)(zi)工(gong)(gong)(gong)程項(xiang)目(mu)不(bu)予批準。政府(fu)投(tou)(tou)資(zi)(zi)(zi)(zi)項(xiang)目(mu)一律不(bu)得以施工(gong)(gong)(gong)企業帶(dai)資(zi)(zi)(zi)(zi)承(cheng)包的方式進行建(jian)設(she),并(bing)嚴禁將(jiang)帶(dai)資(zi)(zi)(zi)(zi)承(cheng)包有關內容寫(xie)入工(gong)(gong)(gong)程承(cheng)包合同(tong)及補(bu)充條款。

  (十六(liu))規范工(gong)(gong)(gong)程(cheng)(cheng)(cheng)款(kuan)支(zhi)付(fu)(fu)和(he)結(jie)算(suan)(suan)行為。全面推行施(shi)工(gong)(gong)(gong)過程(cheng)(cheng)(cheng)結(jie)算(suan)(suan),建(jian)設單位應(ying)按合同約定的計量(liang)周期或(huo)工(gong)(gong)(gong)程(cheng)(cheng)(cheng)進(jin)度結(jie)算(suan)(suan)并支(zhi)付(fu)(fu)工(gong)(gong)(gong)程(cheng)(cheng)(cheng)款(kuan)。工(gong)(gong)(gong)程(cheng)(cheng)(cheng)竣(jun)工(gong)(gong)(gong)驗收后(hou),對(dui)建(jian)設單位未(wei)(wei)完成竣(jun)工(gong)(gong)(gong)結(jie)算(suan)(suan)或(huo)未(wei)(wei)按合同支(zhi)付(fu)(fu)工(gong)(gong)(gong)程(cheng)(cheng)(cheng)款(kuan)且未(wei)(wei)明確剩余工(gong)(gong)(gong)程(cheng)(cheng)(cheng)款(kuan)支(zhi)付(fu)(fu)計劃的,探索建(jian)立(li)建(jian)設項(xiang)目(mu)抵押償付(fu)(fu)制度,有(you)效解(jie)決拖(tuo)欠(qian)工(gong)(gong)(gong)程(cheng)(cheng)(cheng)款(kuan)問題。對(dui)長(chang)期拖(tuo)欠(qian)工(gong)(gong)(gong)程(cheng)(cheng)(cheng)款(kuan)結(jie)算(suan)(suan)或(huo)拖(tuo)欠(qian)工(gong)(gong)(gong)程(cheng)(cheng)(cheng)款(kuan)的建(jian)設單位,有(you)關(guan)部門不(bu)得批(pi)準(zhun)其新項(xiang)目(mu)開工(gong)(gong)(gong)建(jian)設。

  (十七)改革工(gong)(gong)(gong)(gong)(gong)(gong)程(cheng)建設(she)領域用工(gong)(gong)(gong)(gong)(gong)(gong)方(fang)式。加快培(pei)育建筑(zhu)產(chan)業(ye)(ye)工(gong)(gong)(gong)(gong)(gong)(gong)人隊伍,推進(jin)農(nong)民工(gong)(gong)(gong)(gong)(gong)(gong)組(zu)織化進(jin)程(cheng)。鼓勵施工(gong)(gong)(gong)(gong)(gong)(gong)企(qi)(qi)業(ye)(ye)將(jiang)一(yi)部(bu)分技(ji)能水(shui)平高的農(nong)民工(gong)(gong)(gong)(gong)(gong)(gong)招用為自(zi)有工(gong)(gong)(gong)(gong)(gong)(gong)人,不(bu)斷擴大自(zi)有工(gong)(gong)(gong)(gong)(gong)(gong)人隊伍。引導具備條件的勞務(wu)作業(ye)(ye)班組(zu)向專業(ye)(ye)企(qi)(qi)業(ye)(ye)發展。

  (十八)實(shi)行施(shi)工(gong)(gong)現場維(wei)權信(xin)息公(gong)示(shi)制度。施(shi)工(gong)(gong)總(zong)承(cheng)包企(qi)業負責在施(shi)工(gong)(gong)現場醒目位置設立維(wei)權信(xin)息告示(shi)牌,明示(shi)業主單位、施(shi)工(gong)(gong)總(zong)承(cheng)包企(qi)業及所(suo)在項(xiang)目部、分(fen)包企(qi)業、行業監管部門等(deng)基本信(xin)息;明示(shi)勞(lao)動用工(gong)(gong)相(xiang)關(guan)法律法規、當地(di)最低工(gong)(gong)資(zi)標(biao)準、工(gong)(gong)資(zi)支付日期等(deng)信(xin)息;明示(shi)屬地(di)行業監管部門投(tou)訴舉報(bao)電話和勞(lao)動爭議調解(jie)仲裁(cai)、勞(lao)動保障監察投(tou)訴舉報(bao)電話等(deng)信(xin)息,實(shi)現所(suo)有施(shi)工(gong)(gong)場地(di)全覆蓋。

  七、加強組(zu)織(zhi)領導(dao)

  (十九(jiu))落實(shi)(shi)屬地監管責(ze)任(ren)。按照(zhao)屬地管理、分級負責(ze)、誰主管誰負責(ze)的(de)原則,完善(shan)并落實(shi)(shi)解決(jue)拖(tuo)欠農民(min)工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)(zi)問(wen)題(ti)省級人(ren)民(min)政(zheng)(zheng)(zheng)府(fu)負總責(ze),市(地)、縣級人(ren)民(min)政(zheng)(zheng)(zheng)府(fu)具體(ti)負責(ze)的(de)工(gong)(gong)(gong)作(zuo)體(ti)制(zhi)。完善(shan)目(mu)標(biao)責(ze)任(ren)制(zhi)度,制(zhi)定實(shi)(shi)施辦法,將保障農民(min)工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)(zi)支(zhi)付(fu)納入政(zheng)(zheng)(zheng)府(fu)考核評價(jia)指(zhi)標(biao)體(ti)系(xi)。建立定期督查(cha)制(zhi)度,對拖(tuo)欠農民(min)工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)(zi)問(wen)題(ti)高發(fa)頻發(fa)、舉(ju)報投訴量大的(de)地區及重(zhong)大違法案件進行(xing)重(zhong)點督查(cha)。健全問(wen)責(ze)制(zhi)度,對監管責(ze)任(ren)不(bu)落實(shi)(shi)、組織工(gong)(gong)(gong)作(zuo)不(bu)到位的(de),要(yao)嚴格責(ze)任(ren)追究。對政(zheng)(zheng)(zheng)府(fu)投資(zi)(zi)工(gong)(gong)(gong)程(cheng)(cheng)項(xiang)目(mu)拖(tuo)欠工(gong)(gong)(gong)程(cheng)(cheng)款并引發(fa)拖(tuo)欠農民(min)工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)(zi)問(wen)題(ti)的(de),要(yao)追究項(xiang)目(mu)負責(ze)人(ren)責(ze)任(ren)。

  (二十(shi))完善部(bu)(bu)(bu)門協調(diao)(diao)機制(zhi)。健全(quan)解決企業工(gong)資(zi)(zi)拖欠問題部(bu)(bu)(bu)際聯席(xi)會議制(zhi)度,聯席(xi)會議成員單位調(diao)(diao)整為人(ren)力資(zi)(zi)源(yuan)(yuan)社(she)會保(bao)(bao)(bao)障(zhang)(zhang)部(bu)(bu)(bu)、發(fa)展(zhan)改革委、公安部(bu)(bu)(bu)、司法部(bu)(bu)(bu)、財政(zheng)(zheng)部(bu)(bu)(bu)、住房(fang)城鄉建(jian)設部(bu)(bu)(bu)、交通(tong)運輸部(bu)(bu)(bu)、水利部(bu)(bu)(bu)、人(ren)民(min)銀行、國資(zi)(zi)委、工(gong)商總局、全(quan)國總工(gong)會,形成治理欠薪工(gong)作(zuo)合力。地方(fang)各(ge)級人(ren)民(min)政(zheng)(zheng)府(fu)要(yao)建(jian)立(li)健全(quan)由(you)政(zheng)(zheng)府(fu)負(fu)責(ze)(ze)人(ren)牽頭(tou)、相(xiang)關部(bu)(bu)(bu)門參與的(de)(de)工(gong)作(zuo)協調(diao)(diao)機制(zhi)。人(ren)力資(zi)(zi)源(yuan)(yuan)社(she)會保(bao)(bao)(bao)障(zhang)(zhang)部(bu)(bu)(bu)門要(yao)加強(qiang)組織協調(diao)(diao)和督促檢查(cha),加大(da)勞動保(bao)(bao)(bao)障(zhang)(zhang)監(jian)察執法力度。住房(fang)城鄉建(jian)設、交通(tong)運輸、水利等部(bu)(bu)(bu)門要(yao)切實(shi)履行行業監(jian)管(guan)(guan)責(ze)(ze)任(ren),規(gui)范工(gong)程(cheng)建(jian)設市場秩(zhi)序,督促企業落實(shi)勞務(wu)用工(gong)實(shi)名制(zhi)管(guan)(guan)理等制(zhi)度規(gui)定,負(fu)責(ze)(ze)督辦因掛(gua)靠(kao)承包、違法分包、轉包、拖欠工(gong)程(cheng)款等造(zao)成的(de)(de)欠薪案件(jian)。發(fa)展(zhan)改革等部(bu)(bu)(bu)門要(yao)加強(qiang)對政(zheng)(zheng)府(fu)投資(zi)(zi)項(xiang)目的(de)(de)審批(pi)管(guan)(guan)理,嚴格(ge)審查(cha)資(zi)(zi)金(jin)(jin)來(lai)源(yuan)(yuan)和籌措(cuo)方(fang)式(shi)。財政(zheng)(zheng)部(bu)(bu)(bu)門要(yao)加強(qiang)對政(zheng)(zheng)府(fu)投資(zi)(zi)項(xiang)目建(jian)設全(quan)過程(cheng)的(de)(de)資(zi)(zi)金(jin)(jin)監(jian)管(guan)(guan),按規(gui)定及(ji)時撥付(fu)財政(zheng)(zheng)資(zi)(zi)金(jin)(jin)。其他相(xiang)關部(bu)(bu)(bu)門要(yao)根據職責(ze)(ze)分工(gong),積極做好保(bao)(bao)(bao)障(zhang)(zhang)農民(min)工(gong)工(gong)資(zi)(zi)支付(fu)工(gong)作(zuo)。

  (二十一)加大(da)普(pu)法(fa)宣(xuan)傳力度。發揮新(xin)聞媒體宣(xuan)傳引導(dao)(dao)和輿論監督作用(yong),大(da)力宣(xuan)傳勞動保(bao)障(zhang)(zhang)法(fa)律法(fa)規,依(yi)(yi)法(fa)公布典型違法(fa)案件,引導(dao)(dao)企業(ye)(ye)經營(ying)者增強依(yi)(yi)法(fa)用(yong)工、按時足額支付工資(zi)的法(fa)律意識,引導(dao)(dao)農(nong)民(min)工依(yi)(yi)法(fa)理性維權。對重點行(xing)業(ye)(ye)企業(ye)(ye),定(ding)期(qi)開展送法(fa)上(shang)門宣(xuan)講、組(zu)織法(fa)律培訓(xun)等活(huo)動。充分(fen)利用(yong)互(hu)聯(lian)網、微(wei)博、微(wei)信等現代傳媒手段(duan),不(bu)斷創(chuang)新(xin)宣(xuan)傳方式,增強宣(xuan)傳效果,營(ying)造保(bao)障(zhang)(zhang)農(nong)民(min)工工資(zi)支付的良好(hao)輿論氛圍。

  (二十二)加(jia)強法治建設。健全保障(zhang)農(nong)民工工資支(zhi)付的(de)法律制度,在總結相(xiang)關行業(ye)有(you)效做(zuo)法和(he)各(ge)地(di)經驗基(ji)礎(chu)上(shang),加(jia)快工資支(zhi)付保障(zhang)相(xiang)關立法,為維護(hu)農(nong)民工勞動報酬權(quan)益提供法治保障(zhang)。
