住房城鄉建設部關于進一步加強和完善建筑勞務管理工作的指導意見

各省、自治區住房城鄉建設廳,直轄市建委,新疆生產建設兵團建設局:

  為貫徹落(luo)實《關于推進(jin)建(jian)(jian)(jian)筑業(ye)(ye)發展和改革的若(ruo)干意見(jian)》(建(jian)(jian)(jian)市[2014]92號)精(jing)神,加強建(jian)(jian)(jian)筑勞務用工(gong)管理,進(jin)一步落(luo)實建(jian)(jian)(jian)筑施(shi)工(gong)企(qi)業(ye)(ye)在隊伍培育、權益保護(hu)、質量安全等方面的責任,保障勞務人(ren)員合(he)法權益,構(gou)建(jian)(jian)(jian)起有利于形成(cheng)建(jian)(jian)(jian)筑產業(ye)(ye)工(gong)人(ren)隊伍的長(chang)效機制,提高工(gong)程質量水平,促進(jin)建(jian)(jian)(jian)筑業(ye)(ye)健康(kang)發展,提出以下意見(jian):

  一、倡導多元化建(jian)筑用(yong)工(gong)方式,推行實名制管理

  (一(yi))施(shi)工總(zong)承(cheng)包(bao)(bao)、專業(ye)承(cheng)包(bao)(bao)企業(ye)可通(tong)過自有(you)勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)人(ren)員(yuan)或(huo)勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)分包(bao)(bao)、勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)派(pai)遣(qian)等多種方式完成勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)作業(ye)。施(shi)工總(zong)承(cheng)包(bao)(bao)、專業(ye)承(cheng)包(bao)(bao)企業(ye)應(ying)擁有(you)一(yi)定數量的(de)與其建立穩定勞(lao)(lao)(lao)(lao)動關系的(de)骨干技(ji)術工人(ren),或(huo)擁有(you)獨資或(huo)控(kong)股的(de)施(shi)工勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)企業(ye),組織自有(you)勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)人(ren)員(yuan)完成勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)作業(ye);也可以將勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)作業(ye)分包(bao)(bao)給具有(you)施(shi)工勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)資質的(de)企業(ye);還可以將部分臨(lin)時性(xing)(xing)、輔助(zhu)性(xing)(xing)或(huo)者替代性(xing)(xing)的(de)工作使用勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)派(pai)遣(qian)人(ren)員(yuan)完成作業(ye)。

  (二)施(shi)工勞務(wu)(wu)企業應組(zu)織(zhi)自(zi)有勞務(wu)(wu)人(ren)(ren)員(yuan)完成勞務(wu)(wu)分包(bao)作(zuo)業。施(shi)工勞務(wu)(wu)企業應依法承(cheng)接施(shi)工總(zong)承(cheng)包(bao)、專業承(cheng)包(bao)企業發(fa)包(bao)的勞務(wu)(wu)作(zuo)業,并組(zu)織(zhi)自(zi)有勞務(wu)(wu)人(ren)(ren)員(yuan)完成作(zuo)業,不(bu)得(de)將勞務(wu)(wu)作(zuo)業再次(ci)分包(bao)或轉包(bao)。

  (三)推(tui)行勞務(wu)人(ren)(ren)(ren)員(yuan)(yuan)實(shi)名(ming)(ming)制管(guan)理。施工(gong)(gong)(gong)總(zong)承(cheng)(cheng)包(bao)、專(zhuan)業(ye)(ye)承(cheng)(cheng)包(bao)和施工(gong)(gong)(gong)勞務(wu)等建筑施工(gong)(gong)(gong)企(qi)業(ye)(ye)要(yao)嚴格(ge)(ge)落實(shi)勞務(wu)人(ren)(ren)(ren)員(yuan)(yuan)實(shi)名(ming)(ming)制,加強對(dui)自有勞務(wu)人(ren)(ren)(ren)員(yuan)(yuan)的管(guan)理,在施工(gong)(gong)(gong)現(xian)場配(pei)(pei)備(bei)專(zhuan)職或兼職勞務(wu)用(yong)工(gong)(gong)(gong)管(guan)理人(ren)(ren)(ren)員(yuan)(yuan),負責登記勞務(wu)人(ren)(ren)(ren)員(yuan)(yuan)的基本(ben)身(shen)份(fen)信(xin)息(xi)、培訓和技(ji)能狀況(kuang)、從業(ye)(ye)經歷(li)、考勤(qin)記錄、誠信(xin)信(xin)息(xi)、工(gong)(gong)(gong)資結算及支(zhi)(zhi)付(fu)(fu)等情況(kuang),加強勞務(wu)人(ren)(ren)(ren)員(yuan)(yuan)動態監管(guan)和勞務(wu)糾紛調(diao)處。實(shi)行勞務(wu)分包(bao)的工(gong)(gong)(gong)程(cheng)項目,施工(gong)(gong)(gong)勞務(wu)企(qi)業(ye)(ye)除嚴格(ge)(ge)落實(shi)實(shi)名(ming)(ming)制管(guan)理外(wai),還應將現(xian)場勞務(wu)人(ren)(ren)(ren)員(yuan)(yuan)的相(xiang)關(guan)資料(liao)報施工(gong)(gong)(gong)總(zong)承(cheng)(cheng)包(bao)企(qi)業(ye)(ye)核實(shi)、備(bei)查;施工(gong)(gong)(gong)總(zong)承(cheng)(cheng)包(bao)企(qi)業(ye)(ye)也(ye)應配(pei)(pei)備(bei)現(xian)場專(zhuan)職勞務(wu)用(yong)工(gong)(gong)(gong)管(guan)理人(ren)(ren)(ren)員(yuan)(yuan)監督(du)施工(gong)(gong)(gong)勞務(wu)企(qi)業(ye)(ye)落實(shi)實(shi)名(ming)(ming)制管(guan)理,確保工(gong)(gong)(gong)資支(zhi)(zhi)付(fu)(fu)到位,并留存(cun)相(xiang)關(guan)資料(liao)。

  二、落實企業責任,保障(zhang)勞務(wu)人員合(he)法權(quan)益與工程質量安全(quan)

  (四)建筑(zhu)(zhu)施(shi)工(gong)(gong)(gong)企業(ye)對自有(you)勞(lao)務人(ren)員(yuan)承擔用(yong)工(gong)(gong)(gong)主體責(ze)任。建筑(zhu)(zhu)施(shi)工(gong)(gong)(gong)企業(ye)應對自有(you)勞(lao)務人(ren)員(yuan)的施(shi)工(gong)(gong)(gong)現場用(yong)工(gong)(gong)(gong)管理、持證上(shang)崗作業(ye)和工(gong)(gong)(gong)資發放承擔直接責(ze)任。建筑(zhu)(zhu)施(shi)工(gong)(gong)(gong)企業(ye)應與自有(you)勞(lao)務人(ren)員(yuan)依法(fa)(fa)簽(qian)訂書面勞(lao)動(dong)合(he)同,辦理工(gong)(gong)(gong)傷、醫療或綜合(he)保(bao)(bao)險(xian)等社會(hui)保(bao)(bao)險(xian),并按勞(lao)動(dong)合(he)同約定及時將工(gong)(gong)(gong)資直接發放給勞(lao)務人(ren)員(yuan)本人(ren);應不(bu)斷提高和改善勞(lao)務人(ren)員(yuan)的工(gong)(gong)(gong)作條件和生(sheng)活環境,保(bao)(bao)障其合(he)法(fa)(fa)權(quan)益(yi)。

  (五(wu))施(shi)工(gong)(gong)總承(cheng)包(bao)(bao)(bao)(bao)、專業(ye)(ye)承(cheng)包(bao)(bao)(bao)(bao)企(qi)業(ye)(ye)承(cheng)擔(dan)相應(ying)的(de)(de)勞(lao)(lao)(lao)務(wu)(wu)用工(gong)(gong)管(guan)理(li)(li)責(ze)(ze)(ze)任。按(an)照“誰(shui)承(cheng)包(bao)(bao)(bao)(bao)、誰(shui)負(fu)(fu)責(ze)(ze)(ze)”的(de)(de)原(yuan)則,施(shi)工(gong)(gong)總承(cheng)包(bao)(bao)(bao)(bao)企(qi)業(ye)(ye)應(ying)對所(suo)承(cheng)包(bao)(bao)(bao)(bao)工(gong)(gong)程(cheng)的(de)(de)勞(lao)(lao)(lao)務(wu)(wu)管(guan)理(li)(li)全(quan)面負(fu)(fu)責(ze)(ze)(ze)。施(shi)工(gong)(gong)總承(cheng)包(bao)(bao)(bao)(bao)、專業(ye)(ye)承(cheng)包(bao)(bao)(bao)(bao)企(qi)業(ye)(ye)將勞(lao)(lao)(lao)務(wu)(wu)作業(ye)(ye)分包(bao)(bao)(bao)(bao)時,應(ying)對勞(lao)(lao)(lao)務(wu)(wu)費結算支(zhi)付(fu)負(fu)(fu)責(ze)(ze)(ze),對勞(lao)(lao)(lao)務(wu)(wu)分包(bao)(bao)(bao)(bao)企(qi)業(ye)(ye)的(de)(de)日常管(guan)理(li)(li)、勞(lao)(lao)(lao)務(wu)(wu)作業(ye)(ye)和用工(gong)(gong)情況、工(gong)(gong)資(zi)支(zhi)付(fu)負(fu)(fu)監督管(guan)理(li)(li)責(ze)(ze)(ze)任;對因轉包(bao)(bao)(bao)(bao)、違法分包(bao)(bao)(bao)(bao)、拖欠(qian)(qian)工(gong)(gong)程(cheng)款等行為導致拖欠(qian)(qian)勞(lao)(lao)(lao)務(wu)(wu)人(ren)員工(gong)(gong)資(zi)的(de)(de),負(fu)(fu)相應(ying)責(ze)(ze)(ze)任。

  (六)建(jian)筑施(shi)工(gong)(gong)(gong)(gong)企業(ye)(ye)(ye)承(cheng)(cheng)擔勞(lao)(lao)務人員(yuan)(yuan)的(de)(de)(de)教育(yu)培(pei)(pei)(pei)訓(xun)(xun)責任(ren)。建(jian)筑施(shi)工(gong)(gong)(gong)(gong)企業(ye)(ye)(ye)應(ying)(ying)通(tong)過積(ji)極創建(jian)農民工(gong)(gong)(gong)(gong)業(ye)(ye)(ye)余學校、建(jian)立培(pei)(pei)(pei)訓(xun)(xun)基地、師傅帶(dai)徒(tu)弟、現場(chang)培(pei)(pei)(pei)訓(xun)(xun)等(deng)(deng)多種方(fang)式(shi),提(ti)高(gao)勞(lao)(lao)務人員(yuan)(yuan)職業(ye)(ye)(ye)素質和技能(neng)水平(ping),使(shi)其滿足工(gong)(gong)(gong)(gong)作崗(gang)(gang)(gang)位需求。建(jian)筑施(shi)工(gong)(gong)(gong)(gong)企業(ye)(ye)(ye)應(ying)(ying)對(dui)自有勞(lao)(lao)務人員(yuan)(yuan)的(de)(de)(de)技能(neng)和崗(gang)(gang)(gang)位培(pei)(pei)(pei)訓(xun)(xun)負責,建(jian)立勞(lao)(lao)務人員(yuan)(yuan)分類(lei)培(pei)(pei)(pei)訓(xun)(xun)制(zhi)度,實施(shi)全(quan)員(yuan)(yuan)培(pei)(pei)(pei)訓(xun)(xun)、持(chi)證(zheng)上(shang)崗(gang)(gang)(gang)。對(dui)新(xin)進入建(jian)筑市場(chang)的(de)(de)(de)勞(lao)(lao)務人員(yuan)(yuan),應(ying)(ying)組織(zhi)(zhi)相應(ying)(ying)的(de)(de)(de)上(shang)崗(gang)(gang)(gang)培(pei)(pei)(pei)訓(xun)(xun),考核合(he)格后方(fang)可(ke)上(shang)崗(gang)(gang)(gang);對(dui)因(yin)崗(gang)(gang)(gang)位調整或需要轉崗(gang)(gang)(gang)的(de)(de)(de)勞(lao)(lao)務人員(yuan)(yuan),應(ying)(ying)重新(xin)組織(zhi)(zhi)培(pei)(pei)(pei)訓(xun)(xun),考核合(he)格后方(fang)可(ke)上(shang)崗(gang)(gang)(gang);對(dui)從事(shi)建(jian)筑電(dian)工(gong)(gong)(gong)(gong)、建(jian)筑架子工(gong)(gong)(gong)(gong)、建(jian)筑起重信(xin)號司(si)索工(gong)(gong)(gong)(gong)等(deng)(deng)崗(gang)(gang)(gang)位的(de)(de)(de)勞(lao)(lao)務人員(yuan)(yuan),應(ying)(ying)組織(zhi)(zhi)培(pei)(pei)(pei)訓(xun)(xun)并取得住房城(cheng)鄉建(jian)設(she)主管部門(men)頒發的(de)(de)(de)證(zheng)書后方(fang)可(ke)上(shang)崗(gang)(gang)(gang)。施(shi)工(gong)(gong)(gong)(gong)總承(cheng)(cheng)包(bao)、專業(ye)(ye)(ye)承(cheng)(cheng)包(bao)企業(ye)(ye)(ye)應(ying)(ying)對(dui)所承(cheng)(cheng)包(bao)工(gong)(gong)(gong)(gong)程項目施(shi)工(gong)(gong)(gong)(gong)現場(chang)勞(lao)(lao)務人員(yuan)(yuan)的(de)(de)(de)崗(gang)(gang)(gang)前(qian)培(pei)(pei)(pei)訓(xun)(xun)負責,對(dui)施(shi)工(gong)(gong)(gong)(gong)現場(chang)勞(lao)(lao)務人員(yuan)(yuan)持(chi)證(zheng)上(shang)崗(gang)(gang)(gang)作業(ye)(ye)(ye)負監督管理責任(ren)。

  (七)建(jian)筑施工(gong)(gong)企(qi)業(ye)(ye)(ye)承(cheng)擔相應的質(zhi)量(liang)(liang)安全(quan)(quan)責任。施工(gong)(gong)總(zong)承(cheng)包(bao)企(qi)業(ye)(ye)(ye)對(dui)所承(cheng)包(bao)工(gong)(gong)程(cheng)(cheng)項目的施工(gong)(gong)現場質(zhi)量(liang)(liang)安全(quan)(quan)負總(zong)責,專業(ye)(ye)(ye)承(cheng)包(bao)企(qi)業(ye)(ye)(ye)對(dui)承(cheng)包(bao)的專業(ye)(ye)(ye)工(gong)(gong)程(cheng)(cheng)質(zhi)量(liang)(liang)安全(quan)(quan)負責,施工(gong)(gong)總(zong)承(cheng)包(bao)企(qi)業(ye)(ye)(ye)對(dui)分包(bao)工(gong)(gong)程(cheng)(cheng)的質(zhi)量(liang)(liang)安全(quan)(quan)承(cheng)擔連帶(dai)責任。施工(gong)(gong)勞(lao)務企(qi)業(ye)(ye)(ye)應服從施工(gong)(gong)總(zong)承(cheng)包(bao)或專業(ye)(ye)(ye)承(cheng)包(bao)企(qi)業(ye)(ye)(ye)的質(zhi)量(liang)(liang)安全(quan)(quan)管理,組織(zhi)合(he)格的勞(lao)務人(ren)員(yuan)完成施工(gong)(gong)作業(ye)(ye)(ye)。

  三、加(jia)大監管力度(du),規范(fan)勞務用工(gong)管理

  (八)落實(shi)勞務(wu)人(ren)員(yuan)實(shi)名(ming)制管(guan)理(li)各(ge)項要求。各(ge)地住房城鄉(xiang)建(jian)設主(zhu)管(guan)部門應根據本(ben)地區(qu)的(de)(de)實(shi)際情況(kuang),做好實(shi)名(ming)制管(guan)理(li)的(de)(de)宣(xuan)貫、推廣及施(shi)工(gong)現(xian)場的(de)(de)檢(jian)查(cha)、督導工(gong)作。積極推行信(xin)(xin)(xin)息(xi)(xi)(xi)化管(guan)理(li)方式,將勞務(wu)人(ren)員(yuan)的(de)(de)基本(ben)身份信(xin)(xin)(xin)息(xi)(xi)(xi)、培訓和技(ji)能狀(zhuang)況(kuang)、從業經歷和誠(cheng)信(xin)(xin)(xin)信(xin)(xin)(xin)息(xi)(xi)(xi)等內容納(na)入信(xin)(xin)(xin)息(xi)(xi)(xi)化管(guan)理(li)范疇,逐(zhu)步實(shi)現(xian)不同項目(mu)、企(qi)業、地域勞務(wu)人(ren)員(yuan)信(xin)(xin)(xin)息(xi)(xi)(xi)的(de)(de)共享和互通。有(you)條件(jian)的(de)(de)地區(qu),可探索推進勞務(wu)人(ren)員(yuan)的(de)(de)誠(cheng)信(xin)(xin)(xin)信(xin)(xin)(xin)息(xi)(xi)(xi)管(guan)理(li),對(dui)發生違法違規行為以(yi)及引(yin)發群體性事件(jian)的(de)(de)責任人(ren),記錄其不良行為并予以(yi)通報(bao)。

  (九)加大企(qi)(qi)業(ye)違法(fa)違規行為(wei)的(de)查(cha)處力度(du)。各地住房城(cheng)鄉建(jian)設主管(guan)(guan)部門應加大對轉包、違法(fa)分(fen)包等(deng)違法(fa)違規行為(wei)以(yi)及(ji)不(bu)執行實名制(zhi)管(guan)(guan)理和持證上崗制(zhi)度(du)、拖(tuo)欠勞(lao)務(wu)費(fei)或勞(lao)務(wu)人員工(gong)資、引(yin)發群體性討(tao)薪事件(jian)等(deng)不(bu)良行為(wei)的(de)查(cha)處力度(du),并(bing)將查(cha)處結(jie)果予以(yi)通(tong)報(bao),記入(ru)企(qi)(qi)業(ye)信(xin)用檔(dang)案。有條件(jian)的(de)地區可加快施工(gong)勞(lao)務(wu)企(qi)(qi)業(ye)信(xin)用體系建(jian)設,將其不(bu)良行為(wei)統(tong)一納(na)入(ru)全國建(jian)筑市場監管(guan)(guan)與誠信(xin)信(xin)息發布(bu)平臺(tai),向社會公布(bu)。

  四、加強政(zheng)策引導(dao)與扶持,夯(hang)實(shi)行業發展基礎

  (十)加(jia)強(qiang)勞(lao)務(wu)分(fen)包計(ji)價(jia)(jia)(jia)(jia)管理。各地工(gong)(gong)(gong)程(cheng)造價(jia)(jia)(jia)(jia)管理機構應根據本地市場(chang)實(shi)際情(qing)況,動態發(fa)布定(ding)額人工(gong)(gong)(gong)單價(jia)(jia)(jia)(jia)調(diao)整信息,使人工(gong)(gong)(gong)費(fei)用的(de)變化在工(gong)(gong)(gong)程(cheng)造價(jia)(jia)(jia)(jia)中得(de)到及時反(fan)映;實(shi)時跟(gen)蹤勞(lao)務(wu)市場(chang)價(jia)(jia)(jia)(jia)格信息,做好(hao)建筑工(gong)(gong)(gong)種和實(shi)物工(gong)(gong)(gong)程(cheng)量(liang)人工(gong)(gong)(gong)成(cheng)本信息的(de)測算發(fa)布工(gong)(gong)(gong)作(zuo),引導(dao)建筑施工(gong)(gong)(gong)企業合理確(que)定(ding)勞(lao)務(wu)分(fen)包費(fei)用,避(bi)免因(yin)盲目低價(jia)(jia)(jia)(jia)競爭和計(ji)費(fei)方式不合理引發(fa)合同糾紛。

  (十一)推進(jin)建(jian)(jian)(jian)(jian)筑(zhu)勞(lao)(lao)(lao)務(wu)(wu)(wu)基地化(hua)建(jian)(jian)(jian)(jian)設。各地住房(fang)城鄉建(jian)(jian)(jian)(jian)設主管(guan)(guan)(guan)部(bu)門應(ying)結合本地實際,完(wan)善(shan)管(guan)(guan)(guan)理(li)機(ji)制、明確管(guan)(guan)(guan)理(li)機(ji)構、健全(quan)工(gong)作網(wang)絡,推進(jin)建(jian)(jian)(jian)(jian)筑(zhu)勞(lao)(lao)(lao)務(wu)(wu)(wu)基地化(hua)管(guan)(guan)(guan)理(li)工(gong)作開展。以(yi)勞(lao)(lao)(lao)務(wu)(wu)(wu)輸出(chu)為(wei)主地區的(de)(de)住房(fang)城鄉建(jian)(jian)(jian)(jian)設主管(guan)(guan)(guan)部(bu)門應(ying)積(ji)極與(yu)本地相關部(bu)門溝(gou)通(tong)協(xie)調,制定扶持優惠政策,爭取財政資金和各類培(pei)(pei)訓(xun)經(jing)費,加大(da)建(jian)(jian)(jian)(jian)筑(zhu)勞(lao)(lao)(lao)務(wu)(wu)(wu)人員(yuan)職業(ye)(ye)技能(neng)培(pei)(pei)訓(xun)和鑒(jian)定力度,堅持先(xian)培(pei)(pei)訓(xun)后輸出(chu)、先(xian)持證后上崗,多渠(qu)道宣傳推介本地建(jian)(jian)(jian)(jian)筑(zhu)勞(lao)(lao)(lao)務(wu)(wu)(wu)優勢,完(wan)善(shan)建(jian)(jian)(jian)(jian)筑(zhu)勞(lao)(lao)(lao)務(wu)(wu)(wu)輸出(chu)人員(yuan)的(de)(de)跟(gen)蹤服務(wu)(wu)(wu),推進(jin)建(jian)(jian)(jian)(jian)筑(zhu)勞(lao)(lao)(lao)務(wu)(wu)(wu)人員(yuan)組織化(hua)輸出(chu)。勞(lao)(lao)(lao)務(wu)(wu)(wu)輸入地住房(fang)城鄉建(jian)(jian)(jian)(jian)設主管(guan)(guan)(guan)部(bu)門應(ying)積(ji)極協(xie)調本地企業(ye)(ye)與(yu)勞(lao)(lao)(lao)務(wu)(wu)(wu)輸出(chu)地建(jian)(jian)(jian)(jian)立溝(gou)通(tong)、交流(liu)渠(qu)道,鼓勵(li)大(da)型建(jian)(jian)(jian)(jian)筑(zhu)施工(gong)企業(ye)(ye)在(zai)勞(lao)(lao)(lao)務(wu)(wu)(wu)輸出(chu)地建(jian)(jian)(jian)(jian)立獨資或控股的(de)(de)施工(gong)勞(lao)(lao)(lao)務(wu)(wu)(wu)企業(ye)(ye),或與(yu)勞(lao)(lao)(lao)務(wu)(wu)(wu)輸出(chu)地有關單位建(jian)(jian)(jian)(jian)立長(chang)期穩定的(de)(de)合作關系(xi),支持企業(ye)(ye)參與(yu)勞(lao)(lao)(lao)務(wu)(wu)(wu)輸出(chu)地勞(lao)(lao)(lao)務(wu)(wu)(wu)人員(yuan)的(de)(de)技能(neng)培(pei)(pei)訓(xun),建(jian)(jian)(jian)(jian)立雙方定向(xiang)培(pei)(pei)訓(xun)機(ji)制。
