      為(wei)深入貫徹落(luo)實黨的十八大和十八屆三中全會精(jing)神,推進建(jian)筑業發(fa)展和改革,保障(zhang)工(gong)程質量安全,提升工(gong)程建(jian)設(she)水平,針對當前(qian)建(jian)筑市場(chang)和工(gong)程建(jian)設(she)管(guan)理(li)中存在的突出(chu)問題(ti),提出(chu)如下意(yi)見(jian):

      一(yi)、指導思想和(he)發展目標

      (一)指導思想。以鄧小平(ping)理(li)論、“三個代表”重要思想、科(ke)學發展觀為指導,加(jia)快完善現(xian)代市場(chang)(chang)體系,充分發揮(hui)市場(chang)(chang)在資源配置中(zhong)的決定(ding)性作用和(he)更(geng)好發揮(hui)政府(fu)作用,緊緊圍繞正確(que)處理(li)好政府(fu)和(he)市場(chang)(chang)關系的核心(xin),切實轉變(bian)政府(fu)職能,全面深化建(jian)筑業體制機制改革。

      (二)發(fa)展(zhan)目標。簡政放(fang)權,開放(fang)市(shi)(shi)(shi)場(chang)(chang)(chang),堅(jian)持放(fang)管(guan)(guan)并(bing)重,消除市(shi)(shi)(shi)場(chang)(chang)(chang)壁(bi)壘,構建(jian)統一開放(fang)、競爭有序、誠信(xin)守法、監管(guan)(guan)有力的全(quan)國建(jian)筑(zhu)市(shi)(shi)(shi)場(chang)(chang)(chang)體(ti)系;創新和(he)改進(jin)政府對建(jian)筑(zhu)市(shi)(shi)(shi)場(chang)(chang)(chang)、質(zhi)量安全(quan)的監督管(guan)(guan)理機制(zhi),加強事中事后(hou)監管(guan)(guan),強化(hua)(hua)市(shi)(shi)(shi)場(chang)(chang)(chang)和(he)現場(chang)(chang)(chang)聯動,落實各方(fang)主體(ti)責(ze)任,確保工程質(zhi)量安全(quan);轉變建(jian)筑(zhu)業(ye)發(fa)展(zhan)方(fang)式,推(tui)進(jin)建(jian)筑(zhu)產業(ye)現代(dai)化(hua)(hua),促(cu)進(jin)建(jian)筑(zhu)業(ye)健康(kang)協調可持續發(fa)展(zhan)。

      二、建立統(tong)一開放的建筑市場體(ti)系

      (三)進一步開(kai)放(fang)建(jian)(jian)筑(zhu)市場(chang)。各(ge)地(di)要(yao)嚴格(ge)執行(xing)國家相關(guan)法(fa)(fa)(fa)律法(fa)(fa)(fa)規,廢除不利于全(quan)國建(jian)(jian)筑(zhu)市場(chang)統(tong)一開(kai)放(fang)、妨礙企業(ye)公平競爭(zheng)的(de)各(ge)種規定和做法(fa)(fa)(fa)。全(quan)面(mian)清理(li)(li)(li)涉及工(gong)程建(jian)(jian)設企業(ye)的(de)各(ge)類保證(zheng)金、押金等(deng),對于沒有法(fa)(fa)(fa)律法(fa)(fa)(fa)規依據的(de)一律取(qu)消。積極(ji)推行(xing)銀行(xing)保函(han)和誠信(xin)擔保。規范備案管理(li)(li)(li),不得設置任(ren)何排斥、限(xian)制(zhi)(zhi)外(wai)地(di)企業(ye)進入本(ben)地(di)區的(de)準入條(tiao)件,不得強(qiang)制(zhi)(zhi)外(wai)地(di)企業(ye)參加(jia)培(pei)訓(xun)或在(zai)當地(di)成(cheng)立(li)子公司等(deng)。各(ge)地(di)有關(guan)跨省(sheng)承攬(lan)業(ye)務的(de)具體管理(li)(li)(li)要(yao)求(qiu),應當向社會公開(kai)。各(ge)地(di)要(yao)加(jia)強(qiang)外(wai)地(di)企業(ye)準入后(hou)的(de)監(jian)督(du)管理(li)(li)(li),建(jian)(jian)立(li)跨省(sheng)承攬(lan)業(ye)務企業(ye)的(de)違(wei)法(fa)(fa)(fa)違(wei)規行(xing)為處(chu)理(li)(li)(li)督(du)辦、協調機制(zhi)(zhi),嚴厲查處(chu)圍標串標、轉包(bao)、掛靠、違(wei)法(fa)(fa)(fa)分包(bao)等(deng)違(wei)法(fa)(fa)(fa)違(wei)規行(xing)為及質量安全(quan)事(shi)故(gu),對于情節嚴重的(de),予(yu)以清出本(ben)地(di)建(jian)(jian)筑(zhu)市場(chang),并在(zai)全(quan)國建(jian)(jian)筑(zhu)市場(chang)監(jian)管與(yu)誠信(xin)信(xin)息發布平臺曝光(guang)。

      (四)推進(jin)行政審(shen)(shen)(shen)批制(zhi)(zhi)度(du)改革(ge)(ge)。堅持淡化工程(cheng)(cheng)建(jian)設企業(ye)(ye)(ye)資(zi)(zi)質(zhi)(zhi)、強化個(ge)人(ren)(ren)執業(ye)(ye)(ye)資(zi)(zi)格(ge)的(de)(de)(de)改革(ge)(ge)方向,探索(suo)從(cong)主要(yao)依靠資(zi)(zi)質(zhi)(zhi)管(guan)理等(deng)(deng)行政手(shou)段實施市場(chang)準(zhun)入,逐步轉變為(wei)充分發揮(hui)社會信用、工程(cheng)(cheng)擔保(bao)、保(bao)險等(deng)(deng)市場(chang)機制(zhi)(zhi)的(de)(de)(de)作用,實現市場(chang)優(you)勝劣(lie)汰。加快(kuai)研究修訂工程(cheng)(cheng)建(jian)設企業(ye)(ye)(ye)資(zi)(zi)質(zhi)(zhi)標準(zhun)和(he)管(guan)理規定,取消部(bu)分資(zi)(zi)質(zhi)(zhi)類別設置,合并業(ye)(ye)(ye)務范(fan)圍相近的(de)(de)(de)企業(ye)(ye)(ye)資(zi)(zi)質(zhi)(zhi),合理設置資(zi)(zi)質(zhi)(zhi)標準(zhun)條件,注重對(dui)企業(ye)(ye)(ye)、人(ren)(ren)員(yuan)信用狀況(kuang)、質(zhi)(zhi)量安(an)全等(deng)(deng)指標的(de)(de)(de)考(kao)核,強化資(zi)(zi)質(zhi)(zhi)審(shen)(shen)(shen)批后(hou)的(de)(de)(de)動態監(jian)管(guan);簡政放(fang)權,推進(jin)審(shen)(shen)(shen)批權限(xian)下放(fang),健(jian)全完善工程(cheng)(cheng)建(jian)設企業(ye)(ye)(ye)資(zi)(zi)質(zhi)(zhi)和(he)個(ge)人(ren)(ren)執業(ye)(ye)(ye)資(zi)(zi)格(ge)審(shen)(shen)(shen)查(cha)制(zhi)(zhi)度(du);改進(jin)審(shen)(shen)(shen)批方式,推進(jin)電子化審(shen)(shen)(shen)查(cha),加大公開(kai)公示力度(du)。

      (五)改革招標(biao)(biao)(biao)(biao)(biao)投(tou)(tou)標(biao)(biao)(biao)(biao)(biao)監管(guan)方式。調整非(fei)國(guo)有(you)(you)資(zi)(zi)金(jin)投(tou)(tou)資(zi)(zi)項目發(fa)包(bao)方式,試行非(fei)國(guo)有(you)(you)資(zi)(zi)金(jin)投(tou)(tou)資(zi)(zi)項目建(jian)設(she)(she)單(dan)位自主(zhu)決定(ding)是(shi)否(fou)進(jin)行招標(biao)(biao)(biao)(biao)(biao)發(fa)包(bao),是(shi)否(fou)進(jin)入(ru)有(you)(you)形市場開(kai)展工(gong)(gong)程(cheng)交(jiao)易(yi)活動(dong),并由建(jian)設(she)(she)單(dan)位對選擇(ze)的(de)(de)設(she)(she)計(ji)(ji)、施(shi)工(gong)(gong)等單(dan)位承(cheng)(cheng)擔相應(ying)的(de)(de)責任。建(jian)設(she)(she)單(dan)位應(ying)當依法(fa)(fa)將工(gong)(gong)程(cheng)發(fa)包(bao)給具有(you)(you)相應(ying)資(zi)(zi)質的(de)(de)承(cheng)(cheng)包(bao)單(dan)位,依法(fa)(fa)辦理施(shi)工(gong)(gong)許(xu)可、質量安全監督等手續,確保(bao)工(gong)(gong)程(cheng)建(jian)設(she)(she)實(shi)施(shi)活動(dong)規范(fan)有(you)(you)序。各(ge)地要重點加強(qiang)國(guo)有(you)(you)資(zi)(zi)金(jin)投(tou)(tou)資(zi)(zi)項目招標(biao)(biao)(biao)(biao)(biao)投(tou)(tou)標(biao)(biao)(biao)(biao)(biao)監管(guan),嚴格控(kong)制招標(biao)(biao)(biao)(biao)(biao)人設(she)(she)置(zhi)明顯高(gao)于招標(biao)(biao)(biao)(biao)(biao)項目實(shi)際(ji)需要和脫離市場實(shi)際(ji)的(de)(de)不合理條件(jian),嚴禁以各(ge)種形式排斥或限制潛在投(tou)(tou)標(biao)(biao)(biao)(biao)(biao)人投(tou)(tou)標(biao)(biao)(biao)(biao)(biao)。要加快(kuai)推進(jin)電子招標(biao)(biao)(biao)(biao)(biao)投(tou)(tou)標(biao)(biao)(biao)(biao)(biao),進(jin)一步完(wan)善專家評(ping)標(biao)(biao)(biao)(biao)(biao)制度(du),加大社會(hui)監督力度(du),健全中(zhong)標(biao)(biao)(biao)(biao)(biao)候選人公示(shi)制度(du),促進(jin)招標(biao)(biao)(biao)(biao)(biao)投(tou)(tou)標(biao)(biao)(biao)(biao)(biao)活動(dong)公開(kai)透明。鼓勵有(you)(you)條件(jian)的(de)(de)地區探(tan)索開(kai)展標(biao)(biao)(biao)(biao)(biao)后(hou)評(ping)估。勘察、設(she)(she)計(ji)(ji)、監理等工(gong)(gong)程(cheng)服(fu)務的(de)(de)招標(biao)(biao)(biao)(biao)(biao),不得(de)以費用作為唯一的(de)(de)中(zhong)標(biao)(biao)(biao)(biao)(biao)條件(jian)。

      (六)推進(jin)建(jian)(jian)(jian)(jian)(jian)筑(zhu)(zhu)市(shi)(shi)(shi)場(chang)(chang)(chang)(chang)(chang)(chang)(chang)監管(guan)(guan)(guan)信(xin)(xin)息(xi)(xi)化與誠信(xin)(xin)體(ti)(ti)(ti)系建(jian)(jian)(jian)(jian)(jian)設(she)(she)。加快推進(jin)全(quan)國工(gong)(gong)(gong)程(cheng)(cheng)(cheng)建(jian)(jian)(jian)(jian)(jian)設(she)(she)企業(ye)、注冊人員(yuan)、工(gong)(gong)(gong)程(cheng)(cheng)(cheng)項(xiang)(xiang)目(mu)數據(ju)庫(ku)建(jian)(jian)(jian)(jian)(jian)設(she)(she),印(yin)發全(quan)國統一(yi)的數據(ju)標準和(he)(he)管(guan)(guan)(guan)理辦法(fa)。各省級(ji)住(zhu)房(fang)城鄉建(jian)(jian)(jian)(jian)(jian)設(she)(she)主(zhu)管(guan)(guan)(guan)部門(men)要(yao)建(jian)(jian)(jian)(jian)(jian)立建(jian)(jian)(jian)(jian)(jian)筑(zhu)(zhu)市(shi)(shi)(shi)場(chang)(chang)(chang)(chang)(chang)(chang)(chang)和(he)(he)工(gong)(gong)(gong)程(cheng)(cheng)(cheng)質(zhi)量(liang)(liang)(liang)安(an)全(quan)監管(guan)(guan)(guan)一(yi)體(ti)(ti)(ti)化工(gong)(gong)(gong)作平臺(tai),動(dong)態記錄工(gong)(gong)(gong)程(cheng)(cheng)(cheng)項(xiang)(xiang)目(mu)各方主(zhu)體(ti)(ti)(ti)市(shi)(shi)(shi)場(chang)(chang)(chang)(chang)(chang)(chang)(chang)和(he)(he)現(xian)場(chang)(chang)(chang)(chang)(chang)(chang)(chang)行為(wei),有效實現(xian)建(jian)(jian)(jian)(jian)(jian)筑(zhu)(zhu)市(shi)(shi)(shi)場(chang)(chang)(chang)(chang)(chang)(chang)(chang)和(he)(he)現(xian)場(chang)(chang)(chang)(chang)(chang)(chang)(chang)的兩場(chang)(chang)(chang)(chang)(chang)(chang)(chang)聯動(dong)。各級(ji)住(zhu)房(fang)城鄉建(jian)(jian)(jian)(jian)(jian)設(she)(she)主(zhu)管(guan)(guan)(guan)部門(men)要(yao)進(jin)一(yi)步加大信(xin)(xin)息(xi)(xi)的公(gong)開力(li)度,通過(guo)全(quan)國統一(yi)信(xin)(xin)息(xi)(xi)平臺(tai)發布建(jian)(jian)(jian)(jian)(jian)筑(zhu)(zhu)市(shi)(shi)(shi)場(chang)(chang)(chang)(chang)(chang)(chang)(chang)和(he)(he)質(zhi)量(liang)(liang)(liang)安(an)全(quan)監管(guan)(guan)(guan)信(xin)(xin)息(xi)(xi),及時向(xiang)社(she)會(hui)(hui)(hui)公(gong)布行政(zheng)審(shen)批、工(gong)(gong)(gong)程(cheng)(cheng)(cheng)建(jian)(jian)(jian)(jian)(jian)設(she)(she)過(guo)程(cheng)(cheng)(cheng)監管(guan)(guan)(guan)、執(zhi)法(fa)處(chu)罰等信(xin)(xin)息(xi)(xi),公(gong)開曝(pu)光各類市(shi)(shi)(shi)場(chang)(chang)(chang)(chang)(chang)(chang)(chang)主(zhu)體(ti)(ti)(ti)和(he)(he)人員(yuan)的不良行為(wei)信(xin)(xin)息(xi)(xi),形成有效的社(she)會(hui)(hui)(hui)監督機制。各地可(ke)結合本(ben)地實際,制定(ding)完善(shan)相(xiang)關法(fa)規制度,探索開展工(gong)(gong)(gong)程(cheng)(cheng)(cheng)建(jian)(jian)(jian)(jian)(jian)設(she)(she)企業(ye)和(he)(he)從業(ye)人員(yuan)的建(jian)(jian)(jian)(jian)(jian)筑(zhu)(zhu)市(shi)(shi)(shi)場(chang)(chang)(chang)(chang)(chang)(chang)(chang)和(he)(he)質(zhi)量(liang)(liang)(liang)安(an)全(quan)行為(wei)評價(jia)辦法(fa),逐(zhu)步建(jian)(jian)(jian)(jian)(jian)立“守信(xin)(xin)激(ji)勵(li)、失信(xin)(xin)懲(cheng)戒”的建(jian)(jian)(jian)(jian)(jian)筑(zhu)(zhu)市(shi)(shi)(shi)場(chang)(chang)(chang)(chang)(chang)(chang)(chang)信(xin)(xin)用(yong)環境。鼓勵(li)有條(tiao)件的地區研(yan)究、試行開展社(she)會(hui)(hui)(hui)信(xin)(xin)用(yong)評價(jia),引(yin)導建(jian)(jian)(jian)(jian)(jian)設(she)(she)單位等市(shi)(shi)(shi)場(chang)(chang)(chang)(chang)(chang)(chang)(chang)各方主(zhu)體(ti)(ti)(ti)通過(guo)市(shi)(shi)(shi)場(chang)(chang)(chang)(chang)(chang)(chang)(chang)化運作綜合運用(yong)信(xin)(xin)用(yong)評價(jia)結果(guo)。

      (七)進(jin)一步完(wan)善工(gong)程(cheng)(cheng)監(jian)(jian)理(li)(li)制度。分類(lei)指導不(bu)同投資(zi)類(lei)型工(gong)程(cheng)(cheng)項(xiang)(xiang)目監(jian)(jian)理(li)(li)服(fu)務模式發展(zhan)。調(diao)整強(qiang)制監(jian)(jian)理(li)(li)工(gong)程(cheng)(cheng)范圍,選擇部分地區開(kai)展(zhan)試點,研(yan)究制定有能力(li)的(de)(de)建設單(dan)位自主決策選擇監(jian)(jian)理(li)(li)或其(qi)它管(guan)理(li)(li)模式的(de)(de)政(zheng)策措施。具有監(jian)(jian)理(li)(li)資(zi)質(zhi)的(de)(de)工(gong)程(cheng)(cheng)咨詢(xun)服(fu)務機構開(kai)展(zhan)項(xiang)(xiang)目管(guan)理(li)(li)的(de)(de)工(gong)程(cheng)(cheng)項(xiang)(xiang)目,可不(bu)再委托監(jian)(jian)理(li)(li)。推動(dong)一批有能力(li)的(de)(de)監(jian)(jian)理(li)(li)企業做優做強(qiang)。

      (八)強化(hua)建(jian)(jian)(jian)(jian)設(she)單(dan)(dan)位行(xing)(xing)(xing)為(wei)監管。全面落實建(jian)(jian)(jian)(jian)設(she)單(dan)(dan)位項目法(fa)(fa)人(ren)責任(ren)(ren)制,強化(hua)建(jian)(jian)(jian)(jian)設(she)單(dan)(dan)位的(de)質(zhi)量(liang)(liang)責任(ren)(ren)。建(jian)(jian)(jian)(jian)設(she)單(dan)(dan)位不(bu)(bu)(bu)(bu)得(de)違(wei)反工(gong)(gong)(gong)程(cheng)招標(biao)投標(biao)、施工(gong)(gong)(gong)圖審查、施工(gong)(gong)(gong)許可、質(zhi)量(liang)(liang)安全監督及(ji)工(gong)(gong)(gong)程(cheng)竣工(gong)(gong)(gong)驗收(shou)等基本(ben)建(jian)(jian)(jian)(jian)設(she)程(cheng)序,不(bu)(bu)(bu)(bu)得(de)指定分包和(he)(he)肢解(jie)發(fa)包,不(bu)(bu)(bu)(bu)得(de)與(yu)承包單(dan)(dan)位簽訂“陰陽合同(tong)”、任(ren)(ren)意壓縮合理工(gong)(gong)(gong)期和(he)(he)工(gong)(gong)(gong)程(cheng)造價,不(bu)(bu)(bu)(bu)得(de)以任(ren)(ren)何形式要求設(she)計(ji)、施工(gong)(gong)(gong)、監理及(ji)其他技術咨(zi)詢單(dan)(dan)位違(wei)反工(gong)(gong)(gong)程(cheng)建(jian)(jian)(jian)(jian)設(she)強制性(xing)標(biao)準,不(bu)(bu)(bu)(bu)得(de)拖欠(qian)工(gong)(gong)(gong)程(cheng)款。政(zheng)府投資(zi)工(gong)(gong)(gong)程(cheng)一律(lv)不(bu)(bu)(bu)(bu)得(de)采取帶(dai)資(zi)承包方(fang)式進行(xing)(xing)(xing)建(jian)(jian)(jian)(jian)設(she),不(bu)(bu)(bu)(bu)得(de)將帶(dai)資(zi)承包作為(wei)招標(biao)投標(biao)的(de)條件。積極探索研(yan)究對建(jian)(jian)(jian)(jian)設(she)單(dan)(dan)位違(wei)法(fa)(fa)行(xing)(xing)(xing)為(wei)的(de)制約和(he)(he)處(chu)(chu)罰措施。各地要進一步加強對建(jian)(jian)(jian)(jian)設(she)單(dan)(dan)位市場行(xing)(xing)(xing)為(wei)和(he)(he)質(zhi)量(liang)(liang)安全行(xing)(xing)(xing)為(wei)的(de)監督管理,依法(fa)(fa)加大對建(jian)(jian)(jian)(jian)設(she)單(dan)(dan)位違(wei)法(fa)(fa)違(wei)規行(xing)(xing)(xing)為(wei)的(de)處(chu)(chu)罰力度,并將其不(bu)(bu)(bu)(bu)良行(xing)(xing)(xing)為(wei)在(zai)全國建(jian)(jian)(jian)(jian)筑市場監管與(yu)誠(cheng)信信息發(fa)布平臺曝光。

      (九)建(jian)(jian)立與市場經(jing)濟相適應的工程(cheng)(cheng)(cheng)(cheng)造(zao)(zao)價體(ti)系(xi)(xi)。逐步統一各(ge)行業(ye)、各(ge)地區的工程(cheng)(cheng)(cheng)(cheng)計(ji)價規則(ze),服(fu)務建(jian)(jian)筑市場。健全(quan)工程(cheng)(cheng)(cheng)(cheng)量清(qing)單和(he)定(ding)額體(ti)系(xi)(xi),滿(man)足建(jian)(jian)設(she)工程(cheng)(cheng)(cheng)(cheng)全(quan)過程(cheng)(cheng)(cheng)(cheng)不同(tong)設(she)計(ji)深度、不同(tong)復(fu)雜(za)程(cheng)(cheng)(cheng)(cheng)度、多種(zhong)承包方(fang)式的計(ji)價需要。全(quan)面推(tui)行清(qing)單計(ji)價制(zhi)度,建(jian)(jian)立與市場相適應的定(ding)額管(guan)(guan)理機制(zhi),構建(jian)(jian)多元化的工程(cheng)(cheng)(cheng)(cheng)造(zao)(zao)價信(xin)息服(fu)務方(fang)式,清(qing)理調(diao)整與市場不符(fu)的各(ge)類計(ji)價依據(ju),充分(fen)發(fa)(fa)揮造(zao)(zao)價咨詢企業(ye)等第三方(fang)專業(ye)服(fu)務作用,為市場決(jue)定(ding)工程(cheng)(cheng)(cheng)(cheng)造(zao)(zao)價提(ti)供保障。建(jian)(jian)立國家(jia)工程(cheng)(cheng)(cheng)(cheng)造(zao)(zao)價數(shu)據(ju)庫,發(fa)(fa)布(bu)指標指數(shu),提(ti)升造(zao)(zao)價信(xin)息服(fu)務。推(tui)行工程(cheng)(cheng)(cheng)(cheng)造(zao)(zao)價全(quan)過程(cheng)(cheng)(cheng)(cheng)咨詢服(fu)務,強(qiang)化國有投(tou)資工程(cheng)(cheng)(cheng)(cheng)造(zao)(zao)價監(jian)管(guan)(guan)。 

      三、強(qiang)化工(gong)程質(zhi)量安全管理

      (十一)落(luo)(luo)實(shi)各方(fang)主體(ti)的(de)工(gong)程質(zhi)(zhi)量(liang)責任(ren)(ren)。完善(shan)工(gong)程質(zhi)(zhi)量(liang)終(zhong)身責任(ren)(ren)制(zhi),落(luo)(luo)實(shi)參建各方(fang)主體(ti)責任(ren)(ren)。落(luo)(luo)實(shi)工(gong)程質(zhi)(zhi)量(liang)抽查巡查制(zhi)度,推進(jin)實(shi)施分(fen)類監管和(he)差(cha)別化監管。完善(shan)工(gong)程質(zhi)(zhi)量(liang)事故(gu)質(zhi)(zhi)量(liang)問題查處通報制(zhi)度,強化質(zhi)(zhi)量(liang)責任(ren)(ren)追究和(he)處罰。健全(quan)工(gong)程質(zhi)(zhi)量(liang)激勵機制(zhi),營造“優質(zhi)(zhi)優價(jia)”市場(chang)環境。規范(fan)工(gong)程質(zhi)(zhi)量(liang)保(bao)證金管理,積極探(tan)索(suo)試行工(gong)程質(zhi)(zhi)量(liang)保(bao)險(xian)制(zhi)度,對(dui)已實(shi)行工(gong)程質(zhi)(zhi)量(liang)保(bao)險(xian)的(de)工(gong)程,不再(zai)預留質(zhi)(zhi)量(liang)保(bao)證金。

      (十二)完善(shan)工(gong)程(cheng)(cheng)質(zhi)量檢測(ce)(ce)(ce)制度。落實工(gong)程(cheng)(cheng)質(zhi)量檢測(ce)(ce)(ce)責任,提高(gao)施(shi)工(gong)企業(ye)質(zhi)量檢驗能(neng)力。整(zheng)頓規范工(gong)程(cheng)(cheng)質(zhi)量檢測(ce)(ce)(ce)市場,加強檢測(ce)(ce)(ce)過程(cheng)(cheng)和檢測(ce)(ce)(ce)行為(wei)監管(guan),加大對(dui)虛假報告(gao)等(deng)違(wei)法違(wei)規行為(wei)處罰(fa)力度。建立健全政府(fu)對(dui)工(gong)程(cheng)(cheng)質(zhi)量監督(du)抽(chou)測(ce)(ce)(ce)制度,鼓勵各地采取政府(fu)購買服(fu)務等(deng)方(fang)式(shi)加強監督(du)檢測(ce)(ce)(ce)。

      (十四)推(tui)動建(jian)筑(zhu)施工安全(quan)(quan)專項治(zhi)理(li)。研究探索(suo)建(jian)筑(zhu)起重(zhong)機械和模(mo)板支(zhi)架(jia)租賃(lin)、安裝(搭設(she))、使用(yong)、拆除、維護保養一體化管理(li)模(mo)式,提(ti)(ti)升起重(zhong)機械、模(mo)板支(zhi)架(jia)專業化管理(li)水平。規范起重(zhong)機械安裝拆卸工、架(jia)子工等特種作業人員安全(quan)(quan)考(kao)核,提(ti)(ti)高(gao)從(cong)業人員安全(quan)(quan)操作技能。持續開展(zhan)建(jian)筑(zhu)起重(zhong)機械、模(mo)板支(zhi)架(jia)安全(quan)(quan)專項治(zhi)理(li),有效遏制群死群傷事故發生。

      四、促進建筑業發展方式轉變

      (十六)推動(dong)建(jian)(jian)筑(zhu)產業(ye)現(xian)(xian)代化。統籌規劃(hua)建(jian)(jian)筑(zhu)產業(ye)現(xian)(xian)代化發展(zhan)(zhan)目(mu)標(biao)和路徑。推動(dong)建(jian)(jian)筑(zhu)產業(ye)現(xian)(xian)代化結構(gou)(gou)體(ti)系、建(jian)(jian)筑(zhu)設計、部(bu)品構(gou)(gou)件(jian)(jian)配件(jian)(jian)生(sheng)產、施工(gong)、主(zhu)體(ti)裝(zhuang)修集成(cheng)等方面的(de)關鍵(jian)技(ji)術研(yan)究與應(ying)用。制定完(wan)善(shan)有(you)關設計、施工(gong)和驗收(shou)標(biao)準(zhun),組織編制相應(ying)標(biao)準(zhun)設計圖集,指導建(jian)(jian)立(li)標(biao)準(zhun)化部(bu)品構(gou)(gou)件(jian)(jian)體(ti)系。建(jian)(jian)立(li)適(shi)(shi)應(ying)建(jian)(jian)筑(zhu)產業(ye)現(xian)(xian)代化發展(zhan)(zhan)的(de)工(gong)程(cheng)質量安全監(jian)管制度。鼓勵(li)(li)各地制定建(jian)(jian)筑(zhu)產業(ye)現(xian)(xian)代化發展(zhan)(zhan)規劃(hua)以(yi)及財政(zheng)(zheng)、金融、稅(shui)收(shou)、土地等方面激勵(li)(li)政(zheng)(zheng)策,培(pei)育建(jian)(jian)筑(zhu)產業(ye)現(xian)(xian)代化龍頭企業(ye),鼓勵(li)(li)建(jian)(jian)設、勘(kan)察、設計、施工(gong)、構(gou)(gou)件(jian)(jian)生(sheng)產和科研(yan)等單位(wei)建(jian)(jian)立(li)產業(ye)聯盟。進(jin)一步發揮政(zheng)(zheng)府投(tou)資項目(mu)的(de)試點示范引導作用并(bing)適(shi)(shi)時擴大試點范圍,積極穩妥推進(jin)建(jian)(jian)筑(zhu)產業(ye)現(xian)(xian)代化。

      (十七)構建有(you)利于形(xing)成(cheng)建筑(zhu)(zhu)產業(ye)工(gong)(gong)(gong)人(ren)隊伍的(de)(de)長(chang)效(xiao)機制。建立以市(shi)場為(wei)(wei)導向、以關鍵崗位自(zi)有(you)工(gong)(gong)(gong)人(ren)為(wei)(wei)骨干(gan)(gan)、勞(lao)務(wu)分包為(wei)(wei)主要用工(gong)(gong)(gong)來源、勞(lao)務(wu)派遣(qian)為(wei)(wei)臨時(shi)用工(gong)(gong)(gong)補充的(de)(de)多元化(hua)建筑(zhu)(zhu)用工(gong)(gong)(gong)方(fang)式。施工(gong)(gong)(gong)總承包企(qi)業(ye)和專(zhuan)業(ye)承包企(qi)業(ye)要擁有(you)一定數量的(de)(de)技術骨干(gan)(gan)工(gong)(gong)(gong)人(ren),鼓勵施工(gong)(gong)(gong)總承包企(qi)業(ye)擁有(you)獨資或控股的(de)(de)施工(gong)(gong)(gong)勞(lao)務(wu)企(qi)業(ye)。充分利用各類職業(ye)培訓資源,建立多層次的(de)(de)勞(lao)務(wu)人(ren)員(yuan)(yuan)培訓體系(xi)。大力推(tui)進(jin)建筑(zhu)(zhu)勞(lao)務(wu)基地化(hua)建設,堅持(chi)(chi)“先培訓后(hou)輸出、先持(chi)(chi)證(zheng)后(hou)上(shang)(shang)崗”的(de)(de)原則。進(jin)一步落實(shi)(shi)(shi)持(chi)(chi)證(zheng)上(shang)(shang)崗制度(du),從(cong)事關鍵技術工(gong)(gong)(gong)種的(de)(de)勞(lao)務(wu)人(ren)員(yuan)(yuan),應取得相應證(zheng)書后(hou)方(fang)可上(shang)(shang)崗作業(ye)。落實(shi)(shi)(shi)企(qi)業(ye)責任,保障勞(lao)務(wu)人(ren)員(yuan)(yuan)的(de)(de)合(he)法(fa)權益。推(tui)行建筑(zhu)(zhu)勞(lao)務(wu)實(shi)(shi)(shi)名制管理(li),逐步實(shi)(shi)(shi)現建筑(zhu)(zhu)勞(lao)務(wu)人(ren)員(yuan)(yuan)信息化(hua)管理(li)。

      (十八)提(ti)升(sheng)建(jian)筑設(she)(she)計(ji)(ji)(ji)水(shui)平。堅(jian)持以人(ren)為(wei)本、安全集約(yue)、生態環保、傳承(cheng)創新(xin)的(de)理念,樹(shu)立文化(hua)自信,鼓勵(li)建(jian)筑設(she)(she)計(ji)(ji)(ji)創作(zuo)。樹(shu)立設(she)(she)計(ji)(ji)(ji)企業是創新(xin)主(zhu)體的(de)意(yi)識,提(ti)倡精品(pin)設(she)(she)計(ji)(ji)(ji)。鼓勵(li)開(kai)展城市設(she)(she)計(ji)(ji)(ji)工作(zuo),加(jia)強建(jian)筑設(she)(she)計(ji)(ji)(ji)與(yu)城市規(gui)劃間的(de)銜接。探(tan)索放(fang)開(kai)建(jian)筑工程(cheng)方(fang)(fang)案(an)(an)設(she)(she)計(ji)(ji)(ji)資質準入限制,鼓勵(li)相(xiang)關專(zhuan)業人(ren)員(yuan)和(he)機構積極參與(yu)建(jian)筑設(she)(she)計(ji)(ji)(ji)方(fang)(fang)案(an)(an)競選(xuan)。完善建(jian)筑設(she)(she)計(ji)(ji)(ji)方(fang)(fang)案(an)(an)競選(xuan)制度(du),建(jian)立完善大(da)(da)型(xing)公(gong)共建(jian)筑方(fang)(fang)案(an)(an)公(gong)眾參與(yu)和(he)專(zhuan)家輔助決策機制,在方(fang)(fang)案(an)(an)評審中,重視設(she)(she)計(ji)(ji)(ji)方(fang)(fang)案(an)(an)文化(hua)內涵審查(cha)。加(jia)強建(jian)筑設(she)(she)計(ji)(ji)(ji)人(ren)才(cai)隊(dui)伍建(jian)設(she)(she),著(zhu)力培養一批高層次創新(xin)人(ren)才(cai)。開(kai)展設(she)(she)計(ji)(ji)(ji)評優,激(ji)發建(jian)筑設(she)(she)計(ji)(ji)(ji)人(ren)員(yuan)的(de)創作(zuo)激(ji)情。探(tan)索研究大(da)(da)型(xing)公(gong)共建(jian)筑設(she)(she)計(ji)(ji)(ji)后評估(gu)制度(du)。

      (十九)加大(da)工(gong)(gong)(gong)(gong)程(cheng)(cheng)總(zong)承(cheng)包(bao)(bao)(bao)推(tui)(tui)行(xing)力度。倡導工(gong)(gong)(gong)(gong)程(cheng)(cheng)建(jian)設項目(mu)采(cai)用工(gong)(gong)(gong)(gong)程(cheng)(cheng)總(zong)承(cheng)包(bao)(bao)(bao)模式,鼓勵(li)有(you)實力的(de)工(gong)(gong)(gong)(gong)程(cheng)(cheng)設計(ji)(ji)和(he)施工(gong)(gong)(gong)(gong)企業開展工(gong)(gong)(gong)(gong)程(cheng)(cheng)總(zong)承(cheng)包(bao)(bao)(bao)業務(wu)。推(tui)(tui)動建(jian)立適合(he)工(gong)(gong)(gong)(gong)程(cheng)(cheng)總(zong)承(cheng)包(bao)(bao)(bao)發展的(de)招(zhao)標(biao)(biao)投(tou)標(biao)(biao)和(he)工(gong)(gong)(gong)(gong)程(cheng)(cheng)建(jian)設管理機(ji)制,調整現(xian)行(xing)招(zhao)標(biao)(biao)投(tou)標(biao)(biao)、施工(gong)(gong)(gong)(gong)許可、現(xian)場(chang)執法(fa)檢查、竣工(gong)(gong)(gong)(gong)驗(yan)收備(bei)案等環節(jie)管理制度,為推(tui)(tui)行(xing)工(gong)(gong)(gong)(gong)程(cheng)(cheng)總(zong)承(cheng)包(bao)(bao)(bao)創(chuang)造(zao)政策環境(jing)。工(gong)(gong)(gong)(gong)程(cheng)(cheng)總(zong)承(cheng)包(bao)(bao)(bao)合(he)同中涵蓋的(de)設計(ji)(ji)、施工(gong)(gong)(gong)(gong)業務(wu)可以不再通過公開招(zhao)標(biao)(biao)方式確定(ding)分包(bao)(bao)(bao)單位。

      (二十(shi))提(ti)升建筑(zhu)(zhu)業(ye)技(ji)術(shu)能(neng)力。完善以(yi)工(gong)法和專有技(ji)術(shu)成果、試(shi)點(dian)示范工(gong)程(cheng)為抓手的(de)技(ji)術(shu)轉移與(yu)推(tui)(tui)廣機制(zhi),依法保護(hu)知(zhi)識產權。積極推(tui)(tui)動(dong)以(yi)節能(neng)環保為特(te)征的(de)綠(lv)色建造技(ji)術(shu)的(de)應用(yong)。推(tui)(tui)進建筑(zhu)(zhu)信息模型(BIM)等信息技(ji)術(shu)在工(gong)程(cheng)設(she)計(ji)、施(shi)工(gong)和運行維(wei)護(hu)全(quan)過(guo)程(cheng)的(de)應用(yong),提(ti)高綜合效(xiao)益。推(tui)(tui)廣建筑(zhu)(zhu)工(gong)程(cheng)減隔震技(ji)術(shu)。探索(suo)開展白圖替(ti)代藍圖、數字化審圖等工(gong)作(zuo)。建立技(ji)術(shu)研究(jiu)應用(yong)與(yu)標準制(zhi)定有效(xiao)銜接的(de)機制(zhi),促進建筑(zhu)(zhu)業(ye)科技(ji)成果轉化,加快先進適用(yong)技(ji)術(shu)的(de)推(tui)(tui)廣應用(yong)。加大復合型、創新型人才(cai)培養(yang)力度(du)。推(tui)(tui)動(dong)建筑(zhu)(zhu)領域國(guo)際技(ji)術(shu)交流(liu)合作(zuo)。

      五、加強建筑業發展(zhan)和改(gai)革工作的組(zu)織和實施

      (二(er)十一)加(jia)強(qiang)組織領(ling)導(dao)。各(ge)地要高度重視(shi)建筑業發(fa)展和(he)改(gai)革工作(zuo),加(jia)強(qiang)領(ling)導(dao)、明(ming)確責任(ren)、統籌安排,研究制(zhi)定(ding)工作(zuo)方(fang)案,不斷完善相(xiang)關法規制(zhi)度,推(tui)進各(ge)項(xiang)制(zhi)度措施落(luo)實(shi),及(ji)時解(jie)決發(fa)展和(he)改(gai)革中遇到的(de)困(kun)難和(he)問題,整體推(tui)進建筑業發(fa)展和(he)改(gai)革的(de)不斷深化。

      (二(er)(er)十二(er)(er))積極開展(zhan)試點(dian)(dian)。各地(di)要結(jie)合(he)(he)本(ben)地(di)實(shi)際組織開展(zhan)相關試點(dian)(dian)工作(zuo),把試點(dian)(dian)工作(zuo)與(yu)推動(dong)(dong)本(ben)地(di)區工作(zuo)結(jie)合(he)(he)起來,及時分析(xi)試點(dian)(dian)進展(zhan)情況,認真(zhen)總結(jie)試點(dian)(dian)經驗,研究解決試點(dian)(dian)中出(chu)現的問(wen)題,在條件成(cheng)熟時向(xiang)全(quan)國推廣。要加大宣傳推動(dong)(dong)力度,調動(dong)(dong)全(quan)行業(ye)和(he)社會(hui)各方力量,共同推進建(jian)筑業(ye)的發展(zhan)和(he)改革(ge)。

      (二十三(san))加強協(xie)(xie)會(hui)能力建設和行(xing)(xing)(xing)業(ye)(ye)自律。充分發揮(hui)協(xie)(xie)會(hui)在(zai)(zai)規范(fan)行(xing)(xing)(xing)業(ye)(ye)秩序、建立行(xing)(xing)(xing)業(ye)(ye)從業(ye)(ye)人員行(xing)(xing)(xing)為(wei)(wei)準則、促進(jin)(jin)企業(ye)(ye)誠信經營等方面的(de)行(xing)(xing)(xing)業(ye)(ye)自律作用,提(ti)(ti)高協(xie)(xie)會(hui)在(zai)(zai)促進(jin)(jin)行(xing)(xing)(xing)業(ye)(ye)技術進(jin)(jin)步、提(ti)(ti)升行(xing)(xing)(xing)業(ye)(ye)管理水平、反映企業(ye)(ye)訴求、提(ti)(ti)出政(zheng)策(ce)建議等方面的(de)服務(wu)能力。鼓勵行(xing)(xing)(xing)業(ye)(ye)協(xie)(xie)會(hui)研究制(zhi)定非政(zheng)府投資(zi)工程咨詢服務(wu)類收費(fei)行(xing)(xing)(xing)業(ye)(ye)參考價(jia),抵制(zhi)惡意(yi)低(di)價(jia)、不合(he)理低(di)價(jia)競爭(zheng)行(xing)(xing)(xing)為(wei)(wei),維護行(xing)(xing)(xing)業(ye)(ye)發展利益。
